By {{letter dated|date=December 11, 2008|text=letter dated December 11, 2008}}, Arizona Public Service Company (APS) submitted an application for renewal of Operating License Nos. NPF-41, NPF-51, and NPF-74 for the Palo Verde Nuclear Generating Station (PVNGS), Units 1, 2, and 3. The staff of the U.S. Nuclear Regulatory Commission (NRC or the staff) is reviewing this application in accordance with the guidance in NUREG-1800, Standard Review Plan for Review of License Renewal Applications for Nuclear Power Plants. Although the staff has not made an acceptance determination, the staff has identified a deficiency. A description of this deficiency is included in the Enclosure.
In accordance with NUREG-1800, an applicant can modify (i.e., supplement) its application.
The staff requests that APS supplement the license renewal application to address the deficiency described in the Enclosure and submit the supplement to the NRC for review.
Additionally, the staff requests that the application be re-reviewed to identify and correct similar deficiencies that may exist elsewhere in the application. The staff can then continue its review of the application and make a determination as to whether the application is acceptable for docketing. Should the staff find the supplemented application acceptable for docketing, we will establish a review schedule based on the receipt date of your supplement.
Please respond within 14 days of the receipt of this letter to inform the staff of your plans for resolving the deficiency identified in the Enclosure and supplementing the license renewal application.

REVIEW STATUS OF THE LICENSE RENEWAL APPLICATION FOR THE PALO VERDE NUCLEAR GENERATING STATION

Dear Mr. Edington:

By letter dated December 11, 2008, Arizona Public Service Company (APS) submitted an application for renewal of Operating License Nos.

R. Edington If you have any questions on this matter, please contact David Wrona, License Renewal Branch Chief, at 301-415-2292 or Jonathan Rowley, the PVNGS License Renewal Project Manager, at 301-415-4053.

Sincerely,

/RA/

Table 4.3-9 does not include all ASME III Class 1 valves. APS has not yet been able to recover a fatigue analysis, or to confirm that none is required, for every ASME III Class 1 valve greater than four inches nominal inlet whose specification or purchase date indicates a design code edition and addendum that might require a fatigue analysis.

APS will recover and evaluate a fatigue analysis for each remaining ASME III Class 1 valve greater than four inches nominal inlet, for which a fatigue analysis is also otherwise required, before the end of the current licensed operating period.

The staff can not complete its review without the fatigue analysis information included in the license renewal application (LRA). 10 CFR 54.21(c)(1) requires that a list of time-limited aging analyses, as defined by 10 CFR 54.3, be provided in the LRA. These analyses must be received before the staff can complete its acceptance review of the LRA.
