The Nuclear Regulatory Commission (NRC) received the Nuclear Energy Institutes (NEIs)
August 23, 2021, electronic mail (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21236A088), requesting endorsement of NEI 21-06, Guidelines for 10 CFR 50.59 Implementation at Non-Power Production or Utilization Facilities (ADAMS Accession No. ML21236A089).
The version of NEI 21-06, dated August 23, 2021, addresses comments previously provided by the NRC staff (ADAMS Accession No. ML21236A203 and ML21236A202). Therefore, the NRC staff has initiated formal NRC endorsement of NEI 21-06 via the NRCs regulatory guide (RG) process. At your request, while considering public awareness of the development, the NRC staff is expediting the endorsement process and has established a six-month schedule that is already underway. The plan is to issue Draft Regulatory Guide-2007 for public comment by the end of October 2021 with tentative issuance of RG 2.8, Revision 0, by April 2022.
Presently, the NRC staff has not noted any exceptions to full endorsement of NEI 21-06, as submitted. Use of the NEI 21-06 guidance during the NRC endorsement process is at the discretion of the Non-Power Production or Utilization Facility licensees. However, such use is at the licensees risk.
Finally, I wish to express my appreciation of the National Organization of Test, Research, and Training Reactors (TRTR) for effective pre-submittal engagements with the NRC staff, which facilitated early resolution of issues and effective development of this guidance. We look forward to similar pre-submittal engagements with TRTR beginning this Fall to develop the supplemental guidance specific to digital equipment.
