SEABROOK STATION, UNIT NO. 1 - WITHDRAWAL OF REQUESTED LICENSING ACTION RE: EMERGENCY AMENDMENT REQUEST FOR ONE-TIME EXTENSION OF SERVICE WATER SYSTEM/ULTIMATE HEAT SINK ALLOWED OUTAGE TIME (EPID L-2021-LLA-0168)

Dear Mr. Coffey:

By letter dated September 25, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21268A004), NextEra Energy Seabrook, LLC (NextEra) submitted an emergency license amendment request for Seabrook Station, Unit No. 1 (Seabrook). The proposed emergency amendment request would modify Technical Specification (TS) 3.7.4 Action b by extending the allowed outage time on a one-time basis for a service water system cooling water cell from 7 days to 16 days to allow entry into Mode 5 during a planned refueling outage, which is scheduled to begin early October 2021.

On September 23, 2021, NextEra requested the NRC staff to exercise discretion to not enforce compliance with the Action b of TS 3.7.4 which was set to expire on September 24, 2021, at 4:56 a.m. Easter Standard Time (EST). NextEra requested enforcement discretion for a period of 5 days in order to process the subject emergency license amendment request. Based on the NRC staffs evaluation of the licensees request, the staff determined that granting a Notice of Enforcement Discretion (NOED) was consistent with the NRCs Enforcement Policy Manual, Appendix F, Notices of Enforcement Discretion, and staff guidance. Specifically, the NRC determined that it was appropriate to exercise discretion for the brief period of time required for the licensee and the NRC staff to process an emergency license amendment request under the provisions of Title 10 of the Code of Federal Regulations Section 50.91(a)(5) and avoid an unnecessary shutdown of a reactor without a corresponding benefit to public health and safety or the environment. The NOED was verbally communicated to the licensee at approximately 7:30 p.m. EST and documented in a letter dated September 28, 2021 (ADAMS Accession No. ML21271A100). In accordance with the granted NOED, NextEra submitted the subject emergency license amendment request on September 25, 2021.

Coffey By letter dated September 27, 2021 (ADAMS Accession No. ML21270A107), you requested to withdraw the application from NRC review based on repair effort on the service water cooling tower fan, completion of a 24-hour endurance run, and declaration of operability prior to the expiration of the 5-day enforcement discretion period. The NRC acknowledges your request to withdraw the application. NRC staff activities on the review have ceased and the associated Enterprise Project Identifier has been closed.
