NRC Generic Letter 87-09, " Sections 3.0 and 4.0 of the Standard Technical Specifications on the Applicability of Limiting Conditions for Operation and Surveillance Requirements," dated June 4, 1987.
Gentlemen:
In accordance with the provisions of 10 CFR 50.90, as required by 10 CFR50. 59 (c) (1) , the Nebraska Public Power District (NPPD) hereby requests that the Cooper Nuclear Station (CNS)
Technical Specifications (TS) be revised as specified in the attachment.          The proposed change to the CNS TS will make the definition of LIMITING CONDITIONS FOR OPERATION (LCO) consistent with the guidance provided in the Reference.
The proposed change is a Line Item Technical Specifications Improvement and will make the wording of CNS TS definition 1.0.J, concerning entering an operational condition consistent with the wording proposed in NRC Generic Letter 87-09 (reference).
This proposed change has been classified as " exigent" as NPPD has determined that this change is required prior to startup from the current outage.          During a review of the CNS TS the definition of a LCO has been questioned. This definition implies that movement from one operational condition to another is prohibited unless all Action Requirements are cleared.
Therefore, with the present understanding of the LCO definition CNS would not be allowed to start up from the current outage.
This proposed change will incorporate NRC approved terminology for the definition of LCO which would allow startup of CNS.

This proposed change has been reviewed by the necessary Safety Review Committees and incorporates all amendments to the CNS Facility Operating License through Amendment 165 issued July 16, 1993.
By copy of this letter and attachment the appropriate State of Nebraska official is being notified in accordance with 10CFR50. 91 (b) (1) . Copies to the NRC Region IV Office and CNS NRC Resident Inspector are also being sent in accordance with 10CFR50. 4 (b) (2 ) .
