ANDY BATES:  Chairman, Commissioners we have two affirmation items on the schedule. The first one is SECY-12-0063. It is a final rule on revisions to the environmental review for the renewal of nuclear power plant operating licenses. The Commission is being asked to act on a final rule that amends 10 CFR of the Code of Federal Regulations Part 51 Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions. The final rule will redefine the number and the scope of the environmental impact issues that must be addressed by the NRC and applicants during the license renewal environmental reviews. This rule incorporates lessons learned and knowledge gained from license renewal environmental reviews conducted by the NRC since 1996. The Commission has voted to approve the publication and implementation of the final rule. Would you affirm you votes please. CHAIRMAN MACFARLANE:  Aye.

The second item is the Entergy Nuclear Generating Company and Entergy Nuclear Operations, Inc. (Pilgrim Nuclear Power Station), the Jones River Watershed Association and Pilgrim Watch petition for review of LBP-12-11. The Commission is being asked to act on an Order and Memorandum that responds to a petition for review by Pilgrim Watch and Jones River 4 Watershed Association of the Atomic Safety and Licensing Board's decision in LBP-12-11, which denied a request to reopen the proceeding and admit a new contention. The Commission has voted to approve the Memorandum and Order (as attached), which denies the petition for review. Commissioner Apostolakis did not participate in this matter. Would Chairman Macfarlane, Commissioner Svinicki, Commissioners Magwood and Ostendorff affirm your votes please.
