DISCUSSION In accordance with 10 C.F.R. § 2.323(a), the State of New York requests leave to file as an additional exhibit an article that appeared in Nucleonics Week entitled DOE plan coordinates R&D on extending LWR lifetimes by Stephen Dolley.1 The article, which the State has marked and proposes to submit as Exhibit NYS000472, accompanies this motion. The State has consulted with Entergy, NRC Staff, Riverkeeper, and Clearwater pursuant to 10 C.F.R. § 2.323(b), and none of the parties oppose this motion.
Good cause exists for allowing the submission of this exhibit. This exhibit, NYS000472, is relevant to the issues addressed by Contention NYS-38 that the parties and their witnesses may discuss during an evidentiary hearing before the Atomic Safety and Licensing Board. The State and Riverkeepers Joint Revised Statement of Position specifically identified and quoted from the Nucleonics Week article in their Revised Statement of Position for Contention NYS-38/RK-TC-5. See State of New York and Riverkeeper, Inc. Revised Statement of Position in Support of Joint Contention NYS-38/RK-TC-5 (Nov. 9, 2012) NYS000451 at pp. 2 - 3. The article describes ongoing research and development work related to extended operations of power reactors. The article and the citation to federal budget appropriations (Joint Revised SOP at 2) provide context for the intervenors position and also relate to the testimony of Dr. Richard Lahey in support of Contention NYS-38/RK-TC-5. See Pre-Filed Written Rebuttal Testimony of Dr. Richard T. Lahey, Jr. Regarding Contention NYS-38/RK-TC-5 (Nov. 9, 2012) NYS NYS000453 at pp.5, 7. When the intervenors submitted the Statement of Position, the State had understood that the citation to a commonly-available periodical would be sufficient. After discussion among the parties on this matter, the State now seeks to submit the article as an exhibit. As noted, the State of New York has consulted with the other parties pursuant to 10 C.F.R. § 2.323(b), and none of the parties oppose this motion.
