SUBJECT:        NRC INSPECTION REPORT NO. 05000354/2014003 AND NON-CITED
                VIOLATION, HOPE CREEK AND YOUR LETTER DATED AUGUST 27, 2014
Dear Mr. Joyce:
This letter refers to PSEGs August 27, 2014, correspondence, in response to our July 28, 2014,
letter.
Our letter of July 28, 2014, documented one non-cited violation which was identified by the NRC
during an inspection at Hope Creek (Inspection Report No. 05000354/2014003). The NRC
concluded that a violation of Hope Creek Technical Specifications 6.8.1.a, Procedures,
occurred because PSEG procedures HC.OP-AR.ZZ-0006 and HC.OP-AR.ZZ-0022 could
potentially complicate an internal flooding event and adversely affect assumptions in Hope
Creeks flood design. The violation was determined to be of very low safety significance
(Green) and was treated as a non-cited violation.
The PSEG letter denied that a performance deficiency existed and stated that a non-cited
violation should not have been issued. The letter also stated that if the NRC concludes a
performance deficiency does exist, it cannot be substantiated as more than minor. Lastly, the
PSEG letter indicated that the NRCs basis for the associated cross-cutting aspect is not clear.
The basis for each of these disputes was provided. The NRC is in the process of reviewing the
basis of PSEGs disputes and will notify you of the results of our review when the review has
been completed.
In accordance with 10 CFR 2.390 of the NRCs "Rules of Practice," a copy of this letter will
be made available electronically for public inspection in the NRC Public Document Room
or from the NRC document system (ADAMS), accessible from the NRC website at
http://www.nrc.gov/reading-rm/adams.html.
