| | VIOLATION, HOPE CREEK AND YOUR LETTER DATED AUGUST 27, 2014 |
| | Dear Mr. Joyce: |
| | This letter refers to PSEGs August 27, 2014, correspondence, in response to our July 28, 2014, |
| | letter. |
| | Our letter of July 28, 2014, documented one non-cited violation which was identified by the NRC |
| | during an inspection at Hope Creek (Inspection Report No. 05000354/2014003). The NRC |
| | concluded that a violation of Hope Creek Technical Specifications 6.8.1.a, Procedures, |
| | occurred because PSEG procedures HC.OP-AR.ZZ-0006 and HC.OP-AR.ZZ-0022 could |
| | potentially complicate an internal flooding event and adversely affect assumptions in Hope |
| | Creeks flood design. The violation was determined to be of very low safety significance |
| | (Green) and was treated as a non-cited violation. |
| | The PSEG letter denied that a performance deficiency existed and stated that a non-cited |
| | violation should not have been issued. The letter also stated that if the NRC concludes a |
| | performance deficiency does exist, it cannot be substantiated as more than minor. Lastly, the |
| | PSEG letter indicated that the NRCs basis for the associated cross-cutting aspect is not clear. |
| | The basis for each of these disputes was provided. The NRC is in the process of reviewing the |
| | basis of PSEGs disputes and will notify you of the results of our review when the review has |
| | been completed. |
| | In accordance with 10 CFR 2.390 of the NRCs "Rules of Practice," a copy of this letter will |
