ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) will be issued on or about January 21, 2015, to Entergy Operations, Inc. (Entergy) for two violations associated with a Yellow Significance Determination Process finding for Arkansas Nuclear One (ANO) Units 1 and
: 2. The Yellow finding represents an issue of substantial safety significance and will require additional NRC inspections.
The finding involves Entergys failure to design, construct, and maintain ANO Units 1 and 2 auxiliary building and emergency diesel fuel storage building flood barriers so that they could protect safety-related equipment from flooding. Issues identified include over 100 unsealed conduits that penetrated flood barriers, degraded seals that allowed fire water to leak to the adjacent buildings, floor drains and associated lines that did not contain isolation valves and unused ventilation penetrations that were not covered by blind flanges.
The violations associated with the finding are 10 CFR Part 50, Appendix B, Criterion III, Design Control and Criterion V, Instructions, Procedures and Drawings. These regulations require, in part, that measures shall be established to assure that applicable regulatory requirements and the design bases for those structures, systems and components affecting quality are correctly translated into specifications, drawings, procedures and instructions and that those activities affecting quality shall be prescribed by documented instructions, procedures, or drawings, of a type appropriate to the circumstances and shall be accomplished in accordance with these instructions, procedures or drawings, respectively. The violations are considered an escalated enforcement action because they are associated with a Yellow finding.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
