.Logie , Case No. 11-cv-57, pe nding in U.S. District Court in Toledo. Then c ounsel was r eqiure d to prepa re f or ora l arg ument at the Six th Circuit Ci rcuit Court of appe als in a complica ted environmenta l law appe al ca ptioned W eiss v. Salazar , Case No. 10-1313, on October 11, 2011.

Over 250 pag es of br iefing has bee n filed in that matter. Also a s to that appea l, counsel must respond to a 13-pag e "Sug g estion of Mootness" filed in Case No. 10-1313 on Septembe r 29, 2011, which is due prior to the oral a rg ument, as undoubtedly the topic of a lleg ed mootness will be an issue on O ctober 11 at ora l arg ument. Counsel further had to finalize and file a response to a motion for summary judgme nt in a state cour t insurance cover ag e ca se ca ptioned Mason v. Hallowell , Case No. CI 0201007239, pending in L ucas County (Ohio) Court of Common Pleas on Octobe r 5. That motion for summary judgme nt was filed in ea rly Aug ust (and the r esponse did g et in). F inally , counsel ha d to resea rch a nd prepa re the late-f iled memorandum in opposition to the FENOC and N RC motions t o strike in this NRC opera ting lice nse re newa l case , laboring under the incorre ct impression that he had until Octobe r 6, 2011 as a deadline, f or which c ounsel apolog izes.I nterve nors filed on Oc tober 6 a 5 pag e memora ndum setting for th arg uments of law a s their opposition to the moti ons to strike. FENO C and the NRC Staff ca n ill maintain that they are prejudice d by the 3-da y delay in filing, a s the addition of 3 day s to the overa ll tim e the B oard expends in determining the motions t o strike should be of ne g ligible import.

I nterve nors submit that the longstanding , pre-exis ting wor kload of their a ttorney as outlined above pr ovides ade quate e x planation such a s should allow their memorandum to be considere d part of the rec ord. Counsel and I nterve nors do not have a rec ord of de lay ing the se proce eding s and have repe atedly met the time constraints imposed by NRC reg ulations and proce dure.WHEREFORE , I nterve nors pra y the Court allow their opposition memorandum to the motions t o strike to be dee med timely filed, instanter , as of Oc tober 6, 2011.
