Appendix A, General Design Criterion 4 (GDC4)' regarding the treatment of

. postulated-Reactor Coolant System (RCS) main loop and cross-over piping breaks inside containment:at the South Texas Project Units 1 and 2. . By Reference (7) HL&P was informed that further NRC staff action on our exemption request had become unnecessary as a result of Commission approval of a rule

-(51FR12502) .which modified GDC-4 and approved use of' leak-before-break technology as a basis for excluding from the design basis of PWR's the dynamic

. effects of postulated breaks in RCS loop piping. Reference (7) also informed HL&P that, _ in order to -take advantage of the modification to GDC-4, changes to the FSAR would.be required and that a review should be undertaken to determine whether the changes modified design criteria set forth in the PSAR which would require amendment of the construction permit. By Reference (8) HL&P-submitted annotated changes to FSAR Sections 1.3, 3.1, 3.6, 3.8, 3.9, 3.12,-

5.4, 6.2 and various responses to NRC requests for additional information to reflect the implementation of the modification to GDC-4 at STP. By Reference (9) the NRC staff documented their review of the HL&P submittals in References.

'(1) through (6) and reference (8) and the staff's conclusion that STP was in compliance with GDC-4, as revised. By reference (10) HL&P submitted amendment 57 to the-STP FSAR which incorporated the changes previously submitted by reference (8).

HL&P has completed.a review of the STP PSAR and concluded that it would be appropriate to amend the construction permit.

. Accordingly, HL&P, as Project Manager for STP, acting for itself and for the City of San: Antonio (acting by and through the City Public Service Board of San Antonio), Central Power and Light Company, and the City of Austin, Texas, hereby requests that Construction Permit (CP) Nos. CPPR-128 and CPPR-129 be amended to authorize that GDC-4, Requirements for Protection Against Dynamic Effects of Postulated Pipe Rupture, as modified May 12, 1986, is the design basis for the South Texas Project Units 1 and 2. Therefore, the dynamic effects of postulated ruptures in the primary coolant loop piping are excluded from the design basis of both STP Unit I and 2.

In addition we request that Paragraph 3.C of the Construction Permit be revised to read as follows:

This construction permit authorizes the Applicant to construct the facility described in the application and in the hearing record, in accordance with the principal architectural and engineering criteria (except ta tha avtant modifications of such cri-teria may be duly authorized by changes to the Act, rules, regulations, and orders of the Commission) and environmental protection commitments set forth therein.
