On April 26, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 25271) delaying the effective date of a direct final rule published in the Federal Register on February 13, 2023 (88 FR 9106). The direct final rule renews the initial certificate (Amendment 0) and Amendment Nos. 1 through 15 of the Holtec International HI-STORM 100 Certificate of Compliance No. 1014 for 40 years. The delay is necessary for the NRC to evaluate the public comments submitted on the direct final rule. The effective date of May 1, 2023, for the direct final rule published February 13, 2023, is delayed indefinitely.

Reporting Nuclear Medicine Injection Extravasations as Medical Events; Preliminary Proposed Rule Language; Notice of Availability and Public Meeting; Correction; 10 CFR 35 [NRC-2022-0218; RIN3150-AK91]

On April 25, 2023, the NRC published a notice correcting a notice that was published in the Federal Register (88 FR 24924) on April 19, 2023, making available preliminary proposed rule language for a rulemaking on the reporting of nuclear medicine injection extravasations as medical events. This action was necessary to correct the time of the public meeting. The correction took effect on April 25, 2023.

Draft Regulatory Guide: Cybersecurity Event Notifications; Draft Guide; Request for Comment; 10 CFR Part 73 [NRC-2023-0068]

On April 24, 2023, the NRC published a notice in the Federal Register (88 FR 24715) issuing for public comment a draft regulatory guide (DG), DG-5079, Cybersecurity Event Notifications.

This DG is proposed Revision 1 to Regulatory Guide 5.83 of the same name. This proposed revision describes methods that the staff of the NRC considers acceptable for licensees to meet requirements in NRC regulations to report and record cybersecurity events. Comments are due by May 24, 2023.

Nuclear Energy Institute Used Fuel Management Conference During April 25 to 27, 2023, the Office of Nuclear Material Safety and Safeguards staff participated in the Nuclear Energy Institute Used Fuel Management Conference. The staff presented in several panel discussions (including the opening plenary session) on topics including Title 10 of the Code of Federal Regulations 72.48 Changes, Tests, and Experiments, performance margins and regulatory efficiency, phenomena identification and ranking table, and aging management. Several representatives from industry (including licensees, vendors, and dry cask storage certificate holders), Department of Energy, and national labs were in attendance. Industry presentations included consolidated storage and transportation, decommissioning, and used fuel at new reactors.

Office of Administration Items of Interest Week Ending April 28, 2023 Operation, Maintenance, and Support Services for NRCs Acquisition Portal On April 24, 2023, contract number GS00F132DA/31310023F0040 was awarded to Centeva, LLC in Logan, UT. The purpose of this contract is to acquire the associated technical services for development, operations, and maintenance for the NRC Acquisition Portal. The period of performance is from April 21, 2023, through April 20, 2024, with four option periods. The total potential value of the contract can be up to $714,134.13.
