Items of Interest Week Ending March 10, 2023 Restart of the National Institute of Standards and Technology National Bureau of Standards Test Reactor On March 10, 2023, The U.S. Nuclear Regulatory Commission (NRC) staff issued a letter authorizing the restart of the National Institute of Standards and Technology (NIST) National Bureau of Standards Test Reactor (Agencywide Documents Access and Management System Accession No. ML23040A342). NRC authorization to restart the reactor was required since the fuel temperature technical specification safety limit was exceeded during the February 3, 2021, event. As described in the technical evaluation report accompanying the restart authorization, the NRC staff determined that the structures, systems, and components were unaffected during the event and will perform as designed and the licensees corrective actions and enhancements will preclude recurrence of a similar event. The licensee will continue to implement improvements to provide further enhancements to safety and increased NRC oversight of the facility will continue following restart of the reactor. NIST must still finish loading fuel in the core and perform pre-startup checks prior to controlled power ascension which will occur under increased NRC oversight.
Federal Register Notice to Solicit Comments on Draft Interim Staff Guidance, DANU-ISG-2023-01 On March 07, 2023, the NRC staff published a Federal Register Notice (FRN) requesting comments on the draft Interim Staff Guidance (ISG), DANU-ISG-2023-01, "Material Compatibility for non-Light-Water Reactors" (88 FR 14186). The purpose of this ISG is to provide guidance to assist the staff in determining whether an application for a non-light water reactor facility that proposes to use materials allowed under American Society of Mechanical Engineers (ASME) Code Section III, Division 5, High Temperature Reactors, meets the minimum requirements for construction and operation in the area of material compatibility. Specifically, this ISG provides staff guidance on the review of material qualification and performance monitoring programs used to ensure that design requirements will continue to be met throughout the design life of the facility that are not addressed in ASME Code Section III Division 5. The FRN requests comments during a 60-day public comment period ending May 8, 2023. The staff expects to issue the final ISG in Fall 2023.
NRC Grants Approval of Beaver Valley 1 Emergency License Amendment Request On March 6, 2023, the NRC staff granted an emergency amendment to Beaver Valley, Unit 1 (ML23062A521), in response to its March 1, 2023, request. The amendment revised certain technical specifications for the emergency core cooling system (ECCS), allowing a one-time, 36-hour use of an alternate manual flow path for online repairs to be made to a leak from a boron injection tank relief valve in the ECCS system. The duration of the repair is expected to be no more than 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br />. The leak was discovered by the licensee on February 12, 2023.
Margin existed in the amount of ECCS leakage, and the licensee had mitigating actions in place until the leak could be repaired. However, without the emergency amendment to address the issue, the continued leakage could have led to a plant shutdown due to the impact on the control room ventilation limit.

Office of Nuclear Material Safety and Safeguards (NMSS)
Items of Interest Week Ending March 10, 2023 Nuclear Energy Tribal Working Group On February 28, 2023, NMSS staff attended the Nuclear Energy Tribal Working Group (NETWG) hybrid meeting in Albuquerque, New Mexico, and provided updates on Tribal outreach and engagement, which included the NRC consultation information tool, the decommissioning rulemaking, and the subsequent license renewal Generic Environmental Impact Statement rulemaking. The Department of Energy (DOE) discussed the status regarding Ukraine, electrical grid safety and resilience, progress of Clean Energy projects, and opportunities in its Tribal STEM program. The participation included representatives from 10 tribal nations/ organizations, DOE offices of Nuclear Energy, Clean Energy Demonstrations, and National Nuclear Security Administration, and Sandia National Laboratory (Sandia). On March 1, NETWG, NRC, and DOE participants attended a tour of the Sandia facility.
Westinghouse Electric Company Determination Letter On March 9, 2023, staff issued a threshold determination letter (ML23055A301) to Westinghouse Electric Company in response to their December 20, 2022, request for license transfer (ML22354A291). Staff evaluated the request and additional supplements dated February 17th and 27th and determined that the U.S. Nuclear Regulatory Commission (NRC) does not need to provide prior written consent for an interim step of the license transfer under Section 184 of the Atomic Energy Act. Staff expects to complete its review of the final transaction in mid-2023. These licensing actions include the materials license (SNM-1107, for the Columbia Fuel Fabrication Facility) as well as 34 export licenses managed by the Office of International Programs.
American Society of Mechanical Engineers Code Cases and Update Frequency:
Proposed Rule; 10 CFR Part 50 (NRC-2018-0291; RIN 3150-AK23)
On March 6, 2023, the NRC published a notice in the Federal Register (88 FR 13717) proposing to amend its regulations to incorporate by reference proposed revisions of three regulatory guides, which would approve new, revised, and reaffirmed code cases published by the American Society of Mechanical Engineers. This proposed action would allow nuclear power plant licensees and applicants for construction permits, operating licenses, combined licenses, standard design certifications, standard design approvals, and manufacturing licenses to use the code cases listed in these draft regulatory guides as voluntary alternatives to engineering standards for the construction, in-service inspection, and in-service testing of nuclear power plant components. The NRC is requesting comments on this proposed rule and on the draft versions of the three regulatory guides proposed to be incorporated by reference. The NRC also is making available a related draft regulatory guide that lists code cases that the NRC has not approved for use. This draft regulatory guide will not be incorporated by reference into the NRCs regulations. In addition, this rulemaking proposes to extend the time periods required for licensees to update their codes of record. Comments are requested by May 5, 2023.

Sizing of Large Lead-Acid Storage Batteries: Draft Regulatory Guide; Proposed Guide; Request for Comment; 10 CFR Parts 50 and 52 (NRC-2023-0028)
On March 6, 2023, the NRC published a notice in the Federal Register (88 FR 13735) issuing for public comment a draft regulatory guide (DG), DG-1418, Sizing of Large Lead-Acid Storage Batteries. This DG is proposed Revision 2 of Regulatory Guide 1.212 of the same name. DG-1418 describes an approach that is acceptable to the NRC staff to meet regulatory requirements for sizing of large lead-acid storage batteries for production and utilization facilities. It endorses, with clarifications, the Institute of Electrical and Electronic Engineers Standard 485-2020, IEEE Recommended Practice for Sizing Lead-Acid Batteries for Stationary Applications. Comments are requested by April 5, 2023.
Criteria for Programmable Digital Devices in Safety-Related Systems of Nuclear Power Plants: Draft Regulatory Guide; Proposed Guide; Request for Comment; 10 CFR Parts 50 and 52 (NRC-2022-0143)
On March 10, 2023, the NRC published a notice in the Federal Register (88 FR 14957) issuing for public comment a DG, DG-1374, Criteria for Programmable Digital Devices in Safety-Related Systems of Nuclear Power Plants. This DG is proposed Revision 4 of Regulatory Guide 1.152, Criteria for Use of Computers in Safety Systems of Nuclear Power Plants. DG-1374 describes an approach that is acceptable to the NRC staff to meet regulatory requirements for promoting high functional reliability, design quality, and a secure development and operational environment for the use of programmable digital devices in the safety-related systems of nuclear power generating stations. Comments are requested by April 10, 2023.
Renewing Nuclear Power Plant Operating Licenses - Environmental Review: Proposed Rule; Public Meetings and Request for Comment; 10 CFR Part 51 (NRC-2018-0296; RIN 3150-AK32)
On March 10, 2023, the NRC published a notice in the Federal Register (88 FR 14958) announcing plans to hold comment-gathering public meetings on a proposed rule to amend its environmental protection regulations by updating the Commissions 2013 findings on the environmental effect of renewing the operating license of a nuclear power plant. The purpose of the meetings is to provide information and receive public comments on the proposed changes to NRC regulations, draft Revision 2 to NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, and associated guidance. The NRC plans to hold public meetings in March and April 2023 during the 60-day public comment period.
