Items of Interest Week Ending February 3, 2023 Comanche Peak Bulletin 2012-01 Closeout Letter On January 26, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff issued closeout letter (Agencywide Documents Access and Management System Accession No. ML23025A353) for Bulletin 201201, Design Vulnerability in Electric Power System, (ML12074A115) for Comanche Peak Nuclear Power Plant (Comanche Peak). The staff has reviewed the information submitted by Vista Operations Company LLC. (licensee) and the results of NRCs Temporary Instruction 2515/194 inspections for Comanche Peak in reaching the closeout conclusion. With this closeout letter, staff has verified all licensees have adequately addressed the open phase condition issue.

Vogtle Unit 3 Exigent License Amendment Request On February 2, 2023, NRR staff conducted a public meeting for an exigent license amendment for Vogtle Unit 3. Southern Nuclear Company (SNC) submitted the amendment on January 31, 2023, with a requested approval in eight days. The amendment would allow SNC to repair a leaking safety-related valve without de-fueling the reactor. While performing other repairs inside of containment, SNC discovered the leak on a Passive Core Cooling System valve. The leak is below operational limits, but the licensee is opting to make the repair prior to initial criticality. To repair the leak, SNC expects to drain the reactor below the Direct Vessel Injection line, which normally requires de-fueling the reactor, among other actions, per technical specifications.

Holtec Decommissioning International Proposed Regulatory Path to Reauthorize Power Operations at the Palisades Nuclear Plant By letter dated February 1, 2023, Holtec Decommissioning International (HDI) informed the NRC of a regulatory path for the reauthorization of power operations at the Palisades Nuclear Plant under the current regulatory framework (ML23032A399). HDI stated that it was providing NRC staff the information ahead of formal licensing submittals and applications to raise awareness and maintain transparent communications.

Approval of National Institute of Standards and Technology National Bureau of Standards Test Reactor License Amendment Request On February 2, 2023, NRR staff issued a license amendment (ML23020A911) to the National Institute of Standards and Technology National Bureau of Standards Test Reactor (NBSR) that approved changes to the NBSR safety analysis report (SAR). The amendment modifies the SAR to address potential impacts to facility equipment and changes to the facility radiation sources because of some debris remaining in the NBSR primary coolant system following the February 3, 2021, event. This license amendment will inform the staffs decision to approve restart of the NBSR, but the restart decision will not solely rely on this license amendment.

NRCs Attendance at the International Information System on Occupational Exposure ALARA Symposium From January 31 to February 2, 2023, NRR and regional staff attended the 2023 International Information System on Occupational Exposure ALARA Symposium held in Fort Lauderdale, FL.

Commissioner Wright delivered opening remarks on The Future of Nuclear Power in USA and New Regulatory Initiatives. In addition, the staff made presentations on radiation protection related topics including ALARA related inspection findings, violations, and observations, as well as regulatory guidance on calibration of accident range radiation monitors. Attendees provided positive feedback on the staffs presentations and expressed their appreciation of the staffs participation of this symposium.

Items of Interest Week Ending February 3, 2023 NRC Staff Hosts Public Meeting on the Proposed Rule on Alternatives to the Use of Credit Ratings (85 FR 25)

On January 25, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting to discuss the proposed rule, Alternatives to the Use of Credit Ratings (85 FR 25),

and to facilitate stakeholder comments. Approximately 23 people attended the meeting, including representatives from industry and the public. There were no questions or comments from attendees. The NRC staff closed the meeting with a review of how to submit written comments by the March 20, 2023, comment deadline.

NRC Issues Revision No. 2 of Certificate of Compliance No. 9380 for the Westinghouse Model No. Traveller STD and XL Package On January 26, 2023, the staff issued Revision No. 2 of Certificate of Compliance No. 9380 for the Westinghouse Model No. Traveller STD and XL Package. The request was submitted on January 20 to meet a first of a kind accident tolerant fuel high enrichment lead test assembly delivery from the Westinghouse UK fuel fabrication facility to a domestic nuclear power plant in July 2023. Westinghouse requested an expedited review to allow shipments from Competent Authorities at United Kingdom, Netherlands, and Canada. Revised drawings and changes to safety-related material part lists were the focus of staffs review.

NRC Accepts Indirect License Transfer Request for the Proposed Indirect Acquisition of Westinghouse by Brookfield Corporation On January 27, 2023, NMSS accepted the Westinghouse indirect license transfer request related to the proposed indirect acquisition of Westinghouse by Brookfield Corporation (Brookfield Renewable Partners L.P. and Cameco Corporation are partners in the transaction).

The request includes special nuclear materials license SNM-1107 and 33 export licenses.

Westinghouse anticipates the completion of all the needed regulatory approvals and licenses or consents from applicable governmental authorities to complete the sale in the second half of 2023.

NRC Issues Revision No. 11 of the Certificate of Compliance No. 9302 for the MP197HB Package On January 30, 2023, NMSS issued to TN Americas LLC., Revision No. 11 of the Certificate of Compliance No. 9302 for the MP197HB Package. The amendment request included additional variants of Radioactive Waste Containers (RWC) designs that are currently used for storage of activated metal from reactor decommissioning projects and GTCC (greater than Class C) low level waste from operating nuclear power plants. The revised certificate provides the assurance that these additional RWC can be transported to either a consolidated interim storage facility for extended storage or an approved disposal facility.

Industrial Radiographic Operations and Training: Discontinuation of Rulemaking and Denial of Petition for Rulemaking; 10 CFR Part 34 [NRC-2017-0022; NRC-2008-0173; PRM-34-6]

On January 30, 2023, the NRC published a discontinuation of rulemaking and denial of petition for rulemaking in the Federal Register (88 FR 5811), responding to public comments on an interpretation of NRCs requirements for industrial radiographic operations and Agreement State Compatibility Category change for these requirements published in the Federal Register on June 1, 2021 (86 FR 29173). As a result of these actions, the NRC has discontinued a planned rulemaking activity and denied an associated petition for rulemaking, PRM-34-6. The docket for the planned rulemaking activity closed on January 30, 2023.

Licensing Safety Analysis for Loss-of-Coolant Accidents: Petition for Rulemaking; Extension of Comment Period; 10 CFR Part 50 [NRC-2022-0178; PRM-50-124]

On February 2, 2023, the NRC published a notice in the Federal Register (88 FR 7012) requesting comments on a petition for rulemaking (PRM-50-124) submitted by Ralph O. Meyer on August 1, 2022. The petition requests that the NRC revise its regulations regarding the licensing safety analysis for loss-of-coolant accidents. The public comment period was originally scheduled to close on February 6, 2023. The NRC extended the public comment period to allow more time for members of the public to develop and submit their comments. The comment period for the notice published on November 23, 2022 (87 FR 71531), was extended to March 8, 2023.

The purpose of this contract is to acquire the services of one national, full-service, integrated marketing services contractor with previous experience in recruiting and retaining candidates in technical and professional fields. The period of performance is from February 1, 2023, through January 31, 2024, with four option periods. The total potential value of the contract can be up to $1,819,784.09.
