Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending February 10, 2023 Staff Memo to Commission on Vogtle Unit 4 Activities On February 9, 2023, the staff issued a memorandum to the Commission (Agencywide Documents Access and Management System Accession No. ML22214B335) describing activities related to Vogtle Electric Generating Plant, Unit 4 closure of inspections, tests, analyses, and acceptance criteria (ITAAC). The memo also included inspections related to ITAAC and operational programs, current licensing activities, and any possible impact these activities might have on the timing of the staffs finding under Title 10 of the Code of Federal Regulations Part 52.103(g).

Approval of Vogtle Unit 3 Exigent LAR Related to a Passive Core Cooling System Valve On February 8, 2023, the staff issued its safety evaluation approving an exigent license amendment for Vogtle Unit 3 (ML23037A082), meeting Southern Nuclear Companys (SNC) requested-by date. The amendment allows SNC to repair a leaking safety-related valve without having to defuel the reactor, as the unit has never been critical. The valve is part of the Passive Core Cooling System on the Direct Vessel Injection line. The repair of the valve is critical path for the startup of Unit 3. The staff held a public meeting on February 2, 2023, and posted an ad in the Augusta Chronicle to encourage public engagement. No comments were received.

NRC Public Meeting with TerraPower On February 8, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff conducted a virtual public meeting with TerraPower to discuss coordination with federal and state agencies, and engagement with Tribal Nations in support of the environmental report that will be submitted in the Natrium construction permit application expected by February 2024. TerraPowers presentation also included a brief overview of the project environs, including ecological, historic, and cultural resources. Approximately 50 stakeholders attended the meeting, including representatives from non-governmental organizations, congressional offices, and members of the public. TerraPower answered questions posted by NRC staff during the meeting. No questions were received from external stakeholders or members of the public following the business portion of the meeting.

Items of Interest Week Ending February 10, 2023 NRC Publishes Federal Register Notice for the TRISO-X, LLC Fuel Fabrication Facility Licensing Application On February 3, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff published a Federal Register notice (FR. Vol. 88, Pg. 7473-7478) for the TRISO-X, LLC fuel fabrication facility license application announcing the opportunity to request a hearing and to petition for leave to intervene. The notice provides 60 days to respond and ends April 4. The NRC staff are currently reviewing the application (Agencywide Documents Access and Management System Accession No. ML22101A200) and environmental report (ML22266A269) with a projected completion date of early 2025.

West Virginia Governor Submits Letter of Intent to NRC to Become an Agreement State in Accordance with Section 274b of the Atomic Energy Act of 1954, as Amended On February 8, 2023, NRC received a letter from West Virginia Governor Jim Justice to Chair Christopher Hanson indicating the States intent to become an Agreement State in accordance with Section 274b of the Atomic Energy Act of 1954, as amended. Under the Agreement, the NRC would discontinue, and the State of West Virginia would assume the authority to regulate the use of radioactive materials at approximately 160 academic, medical and industrial facilities in the State. The State did not specify a date for the final agreement to be completed.
