Items of Interest Week Ending December 16, 2022 NRC Peer Reviews U.S. Department of Transportation Report On December 16, 2022, the U.S. Department of Transportation Pipelines and Hazardous Materials Safety Administration (PHMSA) held a public meeting to discuss the public release of its report, Updated Safety Review and Assessment of Natural Gas Transmission Pipelines Adjacent to the Indian Point Site, ORNL/SR-2022/2558. The PHMSA requested that Oak Ridge National Laboratory (ORNL) assess the worst-case consequences to the public, Indian Point Energy Center (IPEC) employees, property, and the environment from a hypothetical complete rupture of a natural gas pipeline at the IPEC site. The U.S. Nuclear Regulatory Commission (NRC) peer-reviewed the report and agrees with the conclusion of the report that it is improbable that an unintentional natural gas release from any of the three pipelines will cause physical damage to safety-related structures, systems, or components, or the radioactive waste containers at the IPEC site. PHMSA will be accepting public questions and comments on the report for up to 6 months.
NRC Holds Public Webinar on Licensing of Advanced Reactors On December 15, 2022, the NRC staff held a public webinar with over 95 stakeholders on regulatory improvements to support the licensing of advanced reactors. Topics included new graphite component modeling tools; three technical reports on the MACCS computer code that assess its capability to support advanced reactor licensing reviews; a proposed industry guidance document related to operator licensing for advanced reactors; a discussion on recent new reactor licensing lessons learned; and a discussion on a planned series of workshops on content of applications under the new-design review guide. This meeting was in support of Strategy 2 (analytical tools), Strategy 3 (regulatory framework), and Strategy 4 (codes and standards) of the advanced reactor Implementation Action Plans.
NRC Staff Holds Meeting with Constellation Energy on Limerick License Amendment Requests On December 15, 2022, NRC staff held a public meeting with Constellation Energy to discuss potential exceptions to Institute of Electrical and Electronics Engineers Standard 603-1991, identified in the acceptance letter (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22339A064) for review of Limerick digital instrumentation and controls (I&C) license amendment requests. No regulatory decisions were made in the meeting and the licensees presentation is at ADAMS Accession No. ML22347A153.
NRC Staff Holds Meeting with the Pressurized Water Reactor Owners Group Risk Management Committee On December 14, 2022, NRR staff participated in the Pressurized Water Reactor Owners Group Risk Management Committee meeting. The staff delivered presentations on several topics to communicate various areas where staff is leveraging the Be RiskSMART framework/risk-informed decision-making, including several topics related to Standardized Plant Analysis Risk model updates, Probabilistic Risk Assessment configuration control, and efforts underway in risk-informing evaluations of common cause failures in digital I&C systems (ML22349A648).
The meeting was well-attended and was successful in coordinating future risk-informed activities, as well as sharing industry and NRC staff insights.

TerraPower to Continue Its Natrium Reactor Pre-Application Activities with the NRC Staff On December 13, 2022, TerraPower announced that initial operation of its Natrium reactor in Kemmerer, WY would likely be delayed by at least two years due to uncertainty regarding the availability of High Assay Low Enriched Uranium (HALEU) fuel. The HALEU fuel for the Natrium reactors first core load was originally going to be supplied by Russian state-owned company TENEX (Rosatom). However, TerraPowers announcement stated that it no longer sees this as a viable fuel option for the Natrium reactor. TerraPower is currently engaged in pre-application activities with the NRC staff in support of future licensing of its Natrium reactor design. The HALEU fuel supply chain issues are not expected to affect its ongoing reactor licensing activities and TerraPower indicated that it still expects to submit its construction permit application for the Natrium reactor on the schedule previously communicated to NRC staff.
NRC Staff Holds Meeting with the Boiling Water Reactor Owners Group Executive Oversight Committee On December 12, 2022, NRC staff held a virtual open meeting with the Boiling Water Reactor Owners Group (BWROG) Executive Oversight Committee (EOC) to discuss boiling water reactor issues of interest. Key topics discussed included updates on Revision 4 of the emergency procedures and severe accident guidelines; Technical Specifications Task Force TSTF-576, Revise Safety/Relief Valve Requirements; RG 1.183, Alternative Radiological Source Terms for Evaluating Design Basis Accidents at Nuclear Power Reactors; and digital instrumentation and controls. The NRC and BWROG are planning future interactions on topics of interest. Meeting presentations are available via ADAMS Accession Nos. ML22341A011 and ML22341A012.

Items of Interest Week Ending December 16, 2022 NRC Staff Issues Revision 1 of the Safety Evaluation Report for the Church Rock License Amendment On December 12, 2022, the U.S. Nuclear Regulatory Commission (NRC) staff finalized and issued Revision 1 of the Safety Evaluation Report (SER) for the Church Rock license amendment request to relocate mine waste onto the mill tailings impoundment at the Church Rock site (ML22076A094). The SER states that the license amendment application is in compliance with the applicable requirements of Title 10 of the Code of Federal Regulations Part 40 and Appendix A. Additionally, this SER documents that the mine waste can be disposed of in a manner that will not compromise site reclamation and long-term stability of the mill tailings impoundment.
Virtual Public Meeting on the Activities of the Future of the National Materials Program Working Group On December 12, 2022, the NRC staff held a virtual public meeting to present the activities of the Future of the National Materials Program (NMP) Working Group (ML22326A222). The purpose of this meeting was to inform NRC materials licensees and members of the public of the working groups observations and considerations for the future of the NMP, assuming an increasing number of Agreement States and emerging technologies. The meeting was well-attended with nearly 100 people composed of Agreement State and NRC staff, licensees, and members of the public. The working group members answered questions related to NRC and Agreement State fees, opportunities for Agreement State training, and consistency between Agreement States with respect to guidance development.
Notice of Intent To Conduct Scoping Process and Prepare Environmental Impact Statement; Vistra Operations Company LLC; Comanche Peak Nuclear Power Plant, Units 1 and 2 On December 13, 2022, the NRC published a notice in the Federal Register (87 FR 76219) announcing that the agency will conduct a scoping process to gather information necessary to prepare an environmental impact statement (EIS) to evaluate the environmental impacts for the license renewal of the operating licenses for Comanche Peak Nuclear Power Plant, Units 1 and
- 2. The NRC is seeking public comment on this action and has scheduled public scoping meetings that will take place on January 10, 2023, from 1 to 3 p.m. and 5 to 7 p.m. local time.
Comments on the scope of the EIS are due by January 30, 2023.
Public Meeting on the Rulemaking Considering Changes to Reporting Requirements for Nonemergency Events at Nuclear Power Plants On December 13, 2022, the NRC staff held a public meeting on the rulemaking considering changes to reporting requirements for nonemergency events at nuclear power plants. The purpose of the meeting was to provide information to facilitate stakeholders' comments on the regulatory basis for changes to those requirements (ML22108A004). The meeting had approximately 60 attendees including NRC staff, industry, state representatives, and non-governmental organizations. Staff received good feedback on topics discussed, which included the basis for the staffs recommended changes to the reporting requirements and the costs and benefits of those recommendations.

NRC Staff Issues Revision No. 1 of Certificate of Compliance No. 9375 for the HI-STAR ATB 1T Package to Holtec International On December 13, 2022, the staff issued Revision No. 1 of Certificate of Compliance No. 9375 for the HI-STAR ATB 1T Package to Holtec International. This amendment allows Holtec to have options between two high strength materials for the fabrication of the containment boundary components. The package ships contents described as segmented and non-segmented activated stainless steel or Inconel reactor internals, and surface-contaminated reactor related hardware from reactor decommissioning activities. The package will be used to ship waste to the SKB repository (Sweden) and can be used in the U.S. under specific conditions.
Notice of Intent To Conduct Scoping Process and Prepare Environmental Impact Statement; TRISO-X Special Nuclear Material License On December 16, 2022, the NRC published a notice in the Federal Register (87 FR 77146) announcing that the agency received a license application by letters dated April 5, 2022, and September 23, 2022, from TRISO-X, LLC (TRISO-X) a wholly owned subsidiary of X-energy LLC. By its application, TRISO-X is requesting a license to possess and use special nuclear material for the manufacture of high-assay low-enriched uranium fuel at a fuel fabrication facility to be located in Oak Ridge, Roane County, Tennessee. The proposed action is the issuance of a license for the possession and use of special nuclear material. The NRC staff will prepare an EIS to document the potential environmental impacts from the proposed action. As part of the EIS development process, the NRC is seeking comments on the scope of its environmental review. Comments on the scope of the EIS are due by February 14, 2023.
