Items of Interest Week Ending December 10, 2021 NRC Issues Closeout Letters Regarding Design Vulnerability in Electric Power Systems On December 6, 2021, the U.S. Nuclear Regulatory Commission (NRC) staff issued a closeout letter (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21335A422) for Bulletin 2012-01, Design Vulnerability in Electric Power System, (ADAMS Accession No. ML12074A115) for Susquehanna Steam Electric Station, Units 1 and 2.
The staff reviewed the information submitted by the licensee and the results of NRCs inspections in reaching the closeout conclusion.
NRC Grants COVID-19 Related Exemption for Fermi Unit 2 On December 9, 2021, the NRC granted an exemption (ADAMS Accession No. ML21340A245) to DTE Electric Company for Fermi Unit 2 from specific requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 26, Fitness for Duty Programs, Section 26.205, Work hours. This exemption is related to the COVID-19 public health emergency. The staff reviewed the proposed exemption and determined that pursuant to 10 CFR 26.9, the exemption is authorized by law, will not endanger life or property or the common defense and security, and is otherwise in the public interest.
NRC Accepts Review of Alternate Disposal of Very Low-Level Waste at South Texas Project On December 9, 2021, the staff accepted for review a request by the South Texas Project Nuclear Operating Company for alternate disposal of very low level waste (VLLW) at South Texas Project, Units 1 and 2 (STP) in accordance with 10 CFR 20.2002 (ADAMS Accession No. ML21344A007). The request was submitted by letter dated November 4 (ADAMS Accession No. ML21308A603), and supplemented on December 3 (ADAMS Accession No. ML21337A126), in response to the NRCs previous enforcement discretion related to VLLW alternate disposal at STP into Texas Class 1 or 2 industrial landfills from 2008 through 2018. The staff will continue to exercise enforcement discretion while performing its review of the submittal.

Items of Interest Week Ending December 10, 2021 NMSS Staff Issued its COVID-19 Public Health Emergency Oversight Activities Assessment Phase B Report On December 7, 2021, the NMSS COVID-19 Public Health Emergency Oversight Activities Assessment Phase B Report (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21294A342) was made publicly available. This working group was tasked with evaluating the various practices, adjustments, processes, and inspection techniques utilized to implement the nuclear materials and waste oversight programs during the COVID-19 pandemic. The recently completed report evaluated these topics and proposed recommendations to enhance certain aspects of the oversight programs based on the feedback received internally and externally. NMSS intends to host alignment meetings at all levels prior to implementing any of the proposed recommendations.
NMSS Staff Terminated the Licenses for the General Atomics TRIGA Mark I and Mark F Research Reactors On December 7, 2021, the U.S. Nuclear Regulatory Commission (NRC) terminated License Nos. R-38 and R-67 for the General Atomics TRIGA Mark I and Mark F research reactors located near San Diego, California (ADAMS Accession No. ML21281A171). The staff determined that the site meets the radiological criteria for license termination and has approved the site for unrestricted release in accordance with the criteria for license termination in Title 10 of the Code of Federal Regulations Part 20, Subpart E. The TRIGA Mark I was the initial prototype TRIGA reactor. It achieved initial criticality on May 3, 1958, and was in continuous operation until late 1997. The TRIGA Mark F achieved initial criticality on July 2, 1960, and it was in operation until March 1995.

Availability of Preliminary Proposed Rule Language; Extension of Comment Period; 10 CFR Part 53 (NRC-2019-0062; RIN 3150-AK31)
On December 10, 2021, the NRC published a notice in the Federal Register (86 FR 70423) extending the comment period due date for the reopening of the comment period that was published on November 8, 2021 (86 FR 61718). The public comment period was scheduled to close on January 31, 2022. The NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit their comments. The due date for comments requested in the document published on November 8, 2021, is extended. Comments should be filed no later than August 31, 2022.

On December 9, 2021, the NRC published a notice in the Federal Register (86 FR 69978) amending its spent fuel storage regulations by revising the TN Americas LLC, TN-68 Dry Storage Cask listing within the List of approved spent fuel storage casks to renew, for an DECEMBER 20, 2021 ENCLOSURE D
additional 40 years, the initial certificate and Amendment No. 1 of Certificate of Compliance No.
1027. The renewal of the initial certificate and Amendment No. 1 revises the certificate of compliances conditions and technical specifications to address aging management activities related to the structures, systems, and components (SSCs) of the dry storage system to ensure that the SSCs will maintain their intended functions during the period of extended storage operations. The companion proposed rule was also published in the Federal Register on December 9, 2021 (86 FR 70056). This direct final rule is effective February 22, 2022.
