Items of Interest Week Ending FEBRUARY 5, 2021 NRC Received Letter from the Nuclear Energy Institute Regarding a Proposed Requirement Related to Operational Leakage On January 28, 2021, the NRC staff received a letter from the Nuclear Energy Institute (NEI) regarding a proposed requirement on the evaluation of structural integrity when operational leakage is observed in American Society of Mechanical Engineers Code (ASME Code)
Class 1, 2, and 3 piping systems (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21029A096). The staff intends to include this requirement in the proposed rule to modify Title 10 of the Code of Federal Regulations (10 CFR) Section 50.55a, Codes and standards, to endorse the 2019 edition of the ASME Code. The NEI letter documents comments and concerns raised by NEI and industry representatives during a public meeting on January 19, 2021, to discuss the proposed requirement (ADAMS Accession No. ML21019A294). The staff verbally responded to the comments and concerns during the January 19, 2021, public meeting and intends to provide a written response to the NEI letter.
NRC Issues Regulatory Issue Summary Regarding NRC Emergency Telecommunications System On January 28, 2021, the NRC issued Regulatory Issue Summary (RIS) Regulatory Issue Summary 2000-11, Supplement 2: NRC Emergency Telecommunications System, to alert licensees of NRCs intent to remove the analog phone line made available for accessing the NRC Operations Center Local Area Network (LAN) using a modem that inherently introduces cybersecurity vulnerabilities (ADAMS Accession No. ML20118C661). No specific action is required by this RIS.
NRC Hosted Public Meeting on the Use of Higher Burnup and Increased Enrichment Advanced Boiling Water Reactor Fuels On February 2, 2021, the NRC staff held a partially closed public meeting with Exelon, Southern Nuclear Company (SNC), and Global Nuclear Fuels (GNF) to discuss plans for using higher burnup (HBU) and increased enrichment (IE) advanced boiling water reactor (BWR) fuels, as part of their accident tolerant fuel program (ADAMS Accession No. ML21029A173). The topics discussed included key issues and motivation for HBU and IE for BWR fuels and planned technical activities to support HBU BWR fuels, including risk-informed licensing for HBU extension. Exelon, SNC, and GNF plan to have future interaction with the NRC on their risk-informed fuel licensing approach.

NRC Hosted Public Workshop on 10 CFR Part 53 Advanced Reactor Rulemaking On February 4, 2021, the NRC held a public workshop to provide an opportunity for external stakeholders and the NRC staff to exchange information on the NRCs development of the technology-inclusive 10 CFR Part 53 advanced nuclear reactor rulemaking (ADAMS Accession No. ML21035A040). Discussion topics included the high-level goals, success criteria, key concepts, structure, and key guidance. Stakeholders also provided feedback on preliminary rule language for the previously released Part 53 subparts and for the newly released subpart related to siting requirements, Subpart D (ADAMS Accession No. ML21012A284 and ML21012A278, respectively). Approximately 100 stakeholders attended the meeting, including representatives from NEI, the U.S. Nuclear Industry Council, the Union of Concerned Scientists, and advanced reactor developers. Stakeholders provided varying perspectives on the preliminary rule language that the staff is considering as it updates the previously released preliminary rule language. The next step will be to release preliminary proposed rule language related to construction and manufacturing requirements (Subpart E) to support a public meeting in March.
NRC Hosted Public Meeting on the Topical Report Implementation and Oversight Process On February 4, 2021, the staff held a public meeting to solicit feedback from external stakeholders regarding a staff developed concept called the Topical Report Implementation and Oversight (TRIO) process (ADAMS Accession No. ML21032A043). The TRIO process would leverage the NRCs inspection oversight of fuel vendors to gain efficiency in licensing reviews of the implementation of NRC-approved topical reports. At the meeting, the staff provided an overview of the process and discussed its potential benefits. Most of the comments from the external stakeholders were related to gaining a better understanding of the inspection component of the process. The staff will use the feedback obtained from the meeting to determine if continued development of this process is warranted.
Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Items of Interest Week Ending FEBRUARY 5, 2021 Report on Well Drilling Technologies Now Publicly Available An NRC sponsored study conducted by the Center for Nuclear Waste Regulatory Analyses (CNRWA) entitled, Inadvertent Intruder Well Drilling Final Report, dated December 2020, is now publicly available (Agencywide Documents Access and Management System Accession No. ML20349G094). NRC requested that CNWRA examine existing water well drilling technologies to determine whether any of these have the potential to inadvertently penetrate the thick reinforced concrete covers and steel tank liners that function as intruder barriers for low-level radioactive waste and residual waste disposed at Idaho National Laboratory (INL) and Savannah River Site (SRS). The report concludes that drilling technologies are available to drill through reinforced concrete barriers and presents information on drilling technologies near INL and SRS based on surveys of well drillers in those areas. The report also provides information to help inform inadvertent intruder scenario development and associated biosphere modeling assumptions.
Approval of American Society of Mechanical Engineers Code Cases: Proposed Rule; 10 CFR Part 50 [NRC-2017-0025; RIN 3150-AJ94]
On February 2, 2021, the NRC published a notice in the Federal Register (86 FR 7820) proposing to amend its regulations to incorporate by reference proposed revisions of three regulatory guides, which would approve new, revised, and reaffirmed code cases published by the American Society of Mechanical Engineers. The NRC is also incorporating by reference one NUREG associated with a proposed condition on one of the regulatory guides. The NRC is requesting comments on this proposed rule and on the draft versions of the three regulatory guides proposed to be incorporated by reference. The NRC is also making available a related draft regulatory guide that lists code cases that the NRC has not approved for use. This draft regulatory guide will not be incorporated by reference into the NRCs regulations. Comments are requested by April 5, 2021.
Items Containing Byproduct Material Incidental to Production: Regulatory Basis; Request for Comment; 10 CFR Parts 30 and 32 [NRC-2015-0017; RIN 3150-AJ54 On February 2, 2021, the NRC published a notice in the Federal Register (86 FR 7819) requesting comment on a regulatory basis to support a rulemaking that would amend its regulations by adding a new class exemption from licensing and associated distribution requirements. This new class exemption would create a path for licensing current and future products that contain byproduct material incidental to their production. The rulemaking would resolve a petition for rulemaking, PRM-30-65, submitted by GE Osmonics, Inc. on April 18, 2011, requesting changes to the regulations to allow commercial distribution and redistribution of polycarbonate track etched membranes. Comments are requested by April 5, 2021.

Staff Held Public Meeting on Force-on-Force Inspections On February 3, 2021, NRC staff held a public meeting to discuss considerations that will be used in planning force-on-force inspections in calendar year 2021. In its presentation, staff explained the framework it plans to use to determine whether Inspection Procedure (IP) 71130.03, Contingency Response - Force-on-Force Testing, modified with an addendum for COVID-19 mitigation, or IP 92707, Security Inspection of Facilities Impacted by a Local, State or Federal Emergency where the NRCs Ability to Conduct Triennial Force-on-Force Exercises is Limited will be used.
