Items of Interest Week Ending NOVEMBER 06, 2020 U.S. Nuclear Regulatory Commission (NRC) Hosted a Public Meeting with Technical Specification Task Force On October 30, 2020, NRC staff and the industry-led Technical Specifications Task Force (TSTF) conducted a public meeting (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20290A796) to discuss a proposal to reevaluate the application of Title 10 of the Code of Federal Regulations (10 CFR) 50.36(c)(2)(ii), Criterion 4. This regulation requires a technical specification for plant equipment which operating experience (OpE) or probabilistic risk assessment (PRA) has shown to be significant to safety. Since the initial determinations were made in the 1980's, OpE and PRA have evolved, prompting industry to request a new evaluation. Staff provided feedback during the meeting, which the TSTF will consider as they draft a proposed generic change to the standard technical specifications (TS).
Further interactions are planned in early calendar year 2021.
NRC Staff Hosted a Public Meeting to Discuss Supplier Oversight during Pandemic On November 2, 2020, NRC staff held a public meeting (ADAMS Accession No. ML20293A173) with industry representatives to discuss the industrys approach for performing supplier oversight when the 25% audit frequency extension due to the COVID-19 pandemic is exceeded.
Industry representatives presented their interim approach for provisional procurement authorization and the use of the corrective action program for procurements from suppliers with exceeded audits due to the current pandemic. The NRC staff does not believe that the proposed approach requires approval under 10 CFR 50.54(a)(4), Conditions of Licenses, assuming there are no changes to the licensees quality assurance program descriptions.
NRC Hosted a Public Meeting with the Technical Specification Task Force On November 5, 2020, NRC staff and the industry-led TSTF conducted a public meeting (ADAMS Accession No. ML20297A508) to discuss improvements to the processes related to the Core Operating Limits Report (COLR) requirements in the Standard TS, Section 5.6, "Reporting Requirements." Industry proposed to permit changes to the NRC-approved methods currently in the TS COLR description to be made under 10 CFR 50.59, Changes, tests and experiments, instead of by license amendment request. Staff provided feedback during the meeting, which the TSTF will consider as they draft a proposed generic change to the standard TS. Further interactions are planned for the first quarter of calendar year 2021.
NRC Hosted a Public Webinar on Licensing of Advanced Reactors On November 5, 2020, the NRC staff held a public webinar (ADAMS Accession No. ML20309A954) with over 150 stakeholders on regulatory improvements to support the licensing of advanced reactors. Topics included NRCs draft white paper on promoting preapplication engagement, the recent Advisory Committee on Reactor Safeguards lessons-learned letter regarding new reactor application reviews, licensing and policy considerations for microreactors (see SECY-20-0093; ADAMS Accession No. ML20254A363), Nuclear Energy Innovation and Modernization Act (NEIMA) Section 103(e), the NRCs endorsement review of American Society of Mechanical Engineers (ASME)Section III, Division 5, considerations for streamlining endorsement of ASME Section III, Division I, and Price-Anderson Act considerations for
DECEMBER 22, 2020 ENCLOSURE C advanced reactors. This meeting was in support of Strategy 3 (regulatory framework),
Strategy 4 (codes and standards), and Strategy 5 (resolution of policy issues) of the advanced reactor Implementation Action Plans (ADAMS Accession Nos. ML17165A069 and ML17164A173).
NRC Issued an Information Notice on Fire Protection Equipment Recall On November 5, 2020, the NRC issued Information Notice (IN) 2020-03, Recall of Mechanical Rate of Rise and Fixed-Temperature Heat Detectors (ADAMS Accession No. ML20261H320),
to alert licensees about a recent fire protection equipment recall by the Edwards Fire Safety Company. No specific action is required by this IN.
NRC Issued a Federal Register Notice Related to Rulemaking on 10 CFR Part 53 On November 6, 2020, a notice was issued in the Federal Register (FR) (85 FR 71002) announcing the availability of preliminary proposed rule language related to the safety requirements for the rulemaking on Risk-Informed, Technology-Inclusive Regulatory Framework for Advanced Reactors (10 CFR Part 53). The NRC staff plans to engage stakeholders to discuss preliminary rule language and obtain input every 4-to 6-weeks over the next year; the next meeting is scheduled for November 18, 2020.
Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. Items of Interest Week Ending NOVEMBER 06, 2020 NMSS Staff Issued an Amendment to Prairie Island License On October 29, 2020, the staff issued Amendment 11 to the Prairie Island license No. SNM-2506. The amendment authorized the construction of an additional concrete storage pad and an increase in the amount of material that can be stored at the Independent Spent Fuel Storage Installation. The staff also issued a companion notice to be published in the Federal Register.
NMSS Staff Issued an Amendment to Licenses for American Centrifuge Plant and Lead Cascade Facility On October 30, 2020, the staff amended Centrus Energy Corp./American Centrifuge Operating (ACO) licenses for the American Centrifuge Plant and American Centrifuge Lead Cascade Facility to approve its Classified Matter Protection Plans. This allowed the Office of Nuclear Security and Incident Response to issue a facility clearance to ACO on October 30, 2020, to possess classified matter at its Piketon, Ohio facility, and supports ACOs High Assay Low Enriched Uranium Demonstration Program.
NMSS Staff Held Public Meeting on Enhancements to License Termination Process On October 30, 2020, the staff held a public meeting with the Nuclear Energy Institute (NEI)
Decommissioning Working Group to discuss enhancements to the license termination process.
At the meeting, NMSS outlined its current efforts to risk-inform its licensing and oversight guidance. NEI discussed the development of industry guidance related to license termination plans and final status survey reports, and a communication protocol to improve the quality of interactions between the U.S. Nuclear Regulatory Commission (NRC) and decommissioning licensees throughout the license termination process.
NMSS Staff Held Workshop on Spent Fuel Performance Margins On November 6, 2020, the staff conducted a remote public workshop to continue dialogue on recommendations contained in the Nuclear Energy Institutes white paper on Spent Fuel Performance Margins dated November 8, 2019 (ML19318D971). In particular, the industry and the NRC staff held a table-top exercise during the workshop to facilitate better understanding of the proposed method of evaluation for meeting Title 10 of the Code of Federal Regulations Part 72 regulations pertaining to shielding and dose rate. The staff and the industry gained additional insights based on the outcome of the tabletop exercise which will better inform the implementation plans going forward.
DECEMBER 22, 2020 ENCLOSURE D Non-Substantive Amendments to Adjudicatory Proceeding Requirements: Direct Final Rule; Part 2 of Title 10 of the Code of Federal Regulations (10 CFR)[Regulatory Identifier Number (RIN) 3150-AK46; NRC-2020-0033]
On November 5, 2020, the NRC published a direct final rule in the Federal Register (85 FR 70435) amending its regulations to revise and clarify the agencys rules of practice and procedure to reflect current Atomic Safety and Licensing Board Panel practice, Commission case law, and a decision of the Supreme Court of the United States and to enhance consistency within the NRCs regulations. Comments are requested by December 7, 2020. The companion proposed rule was also published in the Federal Register (85 FR 70507) on November 5, 2020.
This direct final rule is effective January 19, 2021.
Risk-Informed, Technology-Inclusive Regulatory Framework for Advanced Reactors:
Availability of Preliminary Proposed Rule Language; Request for Comment; 10 CFR Part 53 (RIN 3150-AK31; NRC-2019-0062)
On November 6, 2020, the NRC published a notice in the Federal Register (85 FR 71002) seeking public input for developing new requirements for the licensing and regulation of advanced nuclear reactors. The new rulemaking would adopt technology-inclusive approaches and include the appropriate use of risk-informed and performance-based techniques to provide the necessary flexibility for licensing and regulating a variety of advanced nuclear reactor technologies and designs. The NRC is periodically making available for comment preliminary proposed rule language for a risk-informed, technology-inclusive framework that will be added to NRCs regulations in the Code of Federal Regulations. Comments are requested by November 5, 2021.
