Items of Interest Week Ending MAY 15, 2020 Staff Issued Safety Evaluation Related to the COVID-19 Public Health Emergency Regarding Supplier Audits On May 12, 2020, the U.S. Nuclear Regulatory Commission (NRC) issued a Safety Evaluation documenting its review of the Westinghouse Electric Company Topical Report (TR) "Quality Management System (QMS)," Revision 8.0 to extend the period for supplier audits due to COVID-19 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML20132A321). The NRC determined that there is reasonable assurance that Westinghouses QMS TR will continue to meet the requirements of Appendix B to Title 10 of the Code of Federal Regulations (10 CFR) Part 50 and 10 CFR Part 71 Subpart H while implementing the 25 percent extension of audit and survey frequencies during exigent conditions.

Staff Hosted Public Meeting Regarding the Low Safety Significant Issue Resolution Recommendation 5 On May 14, 2020, the NRC staff held a Category 2 meeting to discuss ongoing efforts to address Low Safety Significant Issue Resolution (LSSIR) Recommendation 5 (i.e., assess options for addressing low safety significant issues within the licensing basis) that was endorsed in the LSSIR Recommendation memorandum (ADAMS Accession No. ML19260G224). NRCs experts within the Office of Nuclear Reactor Regulation (NRR) discussed its initiative to develop a streamlined process for the review of risk-informed exemptions to address very low safety significant issues within the licensing basis. Over 80 participants were in attendance.

Staff Hosted Public Meeting with NuScale On May 14, 2020, the NRR staff held a public meeting with NuScale to discuss their approach for evaluating very small breaks and leaks of the reactor coolant system that are included in the design-basis accident analyses for the design. These analyses have been affected by the recent design changes proposed by the applicant. As a result of the public meeting, NuScale agreed to engage in additional discussions with staff to develop a path forward. The staff continues to evaluate the complex design changes and their impact on the overall review schedule.

Staff Issued Two Letters Related to the COVID-19 Public Health Emergency Regarding Biennial Exercises and Select Fire Protection Requirements On May 14, 2020, the NRC staff issued two letters to industry related to the COVID-19 public health emergency (PHE). One letter provides information regarding the NRCs planned actions during the COVID-19 PHE related to the requirements contained in Title 10 of the Code of Federal Regulations (10 CFR) for full participation biennial exercises under Parts 30, 40, 50, 52, 70, and 72 to all NRC licensees that have a radiological emergency plan (ADAMS Accession No. ML20120A003). The second letter provides information regarding NRCs planned actions during the COVID-19 PHE related to requirements contained in 10 CFR, Section 50.48, Fire protection, for fire brigade medical exams, quarterly drills, and annual live fire training (ADAMS Accession No. ML20122A022).

JUNE 4, 2020 ENCLOSURE C Staff Hosted Public Meeting on Regulatory Treatment of Newly Developed Probabilistic Risk Assessment Methods On May 15, 2020, the NRC staff held a Category 2 public meeting with industry representatives to discuss the regulatory treatment of newly developed probabilistic risk assessment methods and associated activities, including the planned update to Regulatory Guide (RG) 1.200, An Approach for Determining Acceptability of Probabilistic Risk Assessment Results for Risk-Informed Activities. Industry conveyed the importance of issuance of the RG as soon as practical, particularly for licensees who are planning to adopt TSTF-505 (i.e., risk-informed extended completion times for technical specifications). NRC staff conveyed to industry that completion of the update of RG 1.200 remains a high priority.

Staff Approved Licensing Requests for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of approved licensing actions provided during this reporting period are summarized below. On May 13, 2020, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (FR) (85 FR 28479) amending its spent fuel storage regulations by revising the Holtec International HI-STORM Flood/Wind Multipurpose Canister Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 5 to Certificate of Compliance No. 1032. The companion proposed rule was also published on May 13, 2020 (85 FR 28251). The direct final rule is effective July 27, 2020.

Emergency Preparedness for Small Modular Reactors and Other New Technologies:

Proposed Rule and Guidance; Request for Comment; 10 CFR Parts 50 and 52 (RIN-3150-AJ68; NRC-2015-0225)

On May 12, 2020, the NRC published a notice in the FR (85 FR 28436) proposing to amend its regulations to include new alternative emergency preparedness (EP) requirements for small modular reactors (SMRs) and other new technologies (ONTs), such as non-light-water reactors (non-LWRs) and certain non-power production or utilization facilities. The new EP requirements would acknowledge technological advancements and other differences from large LWRs that are inherent in SMRs and ONTs. Concurrently, the NRC is issuing for public comment draft Regulatory Guide DG-1350, Performance-Based Emergency Preparedness for Small Modular Reactors, Non-Light-Water Reactors, and Non-power Production or Utilization Facilities. The NRC plans to hold a public meeting to promote full understanding of the proposed rule and guidance and to facilitate public comment. Comments are requested by July 27, 2020.

Backfitting, Forward Fitting, and Issue Finality Guidance: Draft NUREG; Request for Comment; Extension of Comment Period; 10 CFR Chapter 1 (NRC-2018-0142)

On May 15, 2020, the NRC published a notice in the FR (85 FR 29358) extending the comment period for draft NUREG-1409, Backfitting Guidelines, Revision 1, published on March 23, 2020. The public comment period was originally scheduled to close on May 22, 2020. In recognition of the impacts of the current COVID-19 public health emergency across the nation, the NRC has decided to extend the public comment period to allow more time for members of the public to develop and submit comments. The due date of comments requested in the document published on March 23, 2020 (85 FR 28436) is extended. Comments should be filed no later than July 22, 2020.
