Items of Interest Week Ending OCTOBER 4, 2019 Public Meeting to Discuss Planned Revision to Regulatory Guide (RG) 1.200, "An Approach for Determining the Technical Adequacy of Probabilistic Risk Assessment Results for Risk-Informed Activities" On September 27, 2019, the staff held a public meeting with representatives from the Nuclear Energy Institute (NEI), and PWR Owners Group (PWROG) to continue discussions on planned revision to Regulatory Guide (RG) 1.200, "An Approach for Determining the Technical Adequacy of Probabilistic Risk Assessment Results for Risk-Informed Activities ." Among other things, this planned revision to RG 1.200 will endorse NEI 17-07 (a revision to the industry peer-review process) and review requirements for Probabilistic Risk Assessment methods that PWROG has developed . Staff is developing plans to complete this update in fiscal year 2020.

Public Meeting to Discuss Status of Reactor Oversight Process On September 25, 2019, the staff held a public meeting with the industry's Reactor Oversight Process (ROP) Task Force to discuss the status of ROP topics. Discussion topics included Significance Determination Process (SOP) updates; the Nuclear Energy lnstitute's (NEl's) request for changes to the SOP appeal process (ADAMS Accession Nos. ML19261A190 and ML19263D136); updates on Phase 2 activities for the ROP enhancement project, with a presentation focused on cross-cutting issues ADAMS Accession Nos. ML192638162 and ML19266A601 ); and a detailed discussion on the staff's review of problem identification and resolution inspection. The staff also discussed a white paper submitted by NEI on counting drill exercise performance (ADAMS Accession No. ML19266A321). The meeting, which was advertised on social media, was well attended by representatives from various State Liaison Offices and members of the public, who were active participants in the meeting topics. The next monthly public meeting between the staff and the ROP Task Force is tentatively scheduled for October 23, 2019.

Staff Completed Its Revision of IMC 0326, "Operability Determinations" On September 30, 2019, the staff completed its revision of IMC 0326, "Operability Determinations," which was implemented on October 1, 2019. This enhanced inspector guidance is the result of a year-long effort by the agencywide working group, which will be conducting roll-out training to all four regions during the month of October.

Items of Interest Week Ending OCTOBER 4, 2019 State of Vermont: Discontinuance of Certain Commission Regulatory Authority Within the State; Notice of Agreement Between the NRC and the State of Vermont; Final State Agreement (NRC-2019-0114)

On September 30, 2019, the NRC published in the Federal Register (84 FR 29811) a notice announcing that on September 9, 2019, Kristine L. Svinicki, Chairman of the U.S. Nuclear Regulatory Commission, and on September 13, 2019, Governor Philip B. Scott of the State of Vermont, signed an Agreement as authorized by Section 274b of the Atomic Energy Act of 1954, as amended. Under the Agreement, the Commission discontinues its regulatory authority, and the State of Vermont assumes regulatory authority over 11 e(1 ), 11 e(3), and 11 e(4) byproduct materials, source materials, and special nuclear materials in quantities not sufficient to form a critical mass. The effective date of the Agreement is September 30, 2019.

14; Direct Final Rule; 10 CFR Part 72 [RIN 3150-AK36; NRC-2019-01601 On October 3, 2019, the NRC published a direct final rule in the Federal Register(84 FR 52747) amending its spent fuel storage regulations by revising the Holtec International HI-STORM 100 Multipurpose Canister System listing within the "List of approved spent fuel storage casks" to include Amendment No. 14 to Certificate of Compliance No. 1014. Amendment No. 14 revises the technical specifications and makes other administrative changes . A companion proposed rule was also published in the Federal Register on May 15, 2019 (84 FR 21728). The direct final rule will become effective on December 17, 2019, unless significant adverse comments are received.

Items of Interest Week Ending OCTOBER 4, 2019 On January 31 , 2019, the Regional Administrator (RA) for the U.S. Nuclear Regulatory Commission's (NRC's) Region IV office issued a formal decision on a Differing Professional Opinion (DPO) submitted on February 5, 2018, involving a supplemental inspection conducted by NRC Region IV inspectors at the Columbia Generating Station (CGS) . This inspection was chartered to review the licensee's root cause and corrective actions stemming from a radioactive waste shipping incident a year earlier. The DPO stated that that the results of the supplemental inspection were not supported by the information documented in the associated NRC inspection report, the NRC inappropriately closed the finding in the Public Radiation Safety cornerstone and a potential violation 10 CFR 50.5 might exist. On June 28, 2018, an Ad Hoc Panel (Panel) provided the results of its independent review of the DPO to the Region IV RA The RA directed the staff to amend the CGS supplemental inspection report to add supplementary information that provided a more robust explanation of the basis for the staff's conclusion. The RA further agreed with the Panel that there was insufficient evidence to support a 10 CFR 50.5 violation . On February 4, 2019, the DPO submitter filed an appeal of the RA decision to the NRC's Executive Director for Operations (EDO) . After considering the DPO appeal , the EDO upheld the RA's decision .
