April 14, 2014 U.S. Nuclear Regulatory Commission Page 3 In Reference 1, Constellation Energy Nuclear Group, LLC (CENG) requested NRC approval of a delay in applying for the renewal of the CENG Facility Security Clearance. The proposed delay was based on the pending transfer of the operating licenses for R.E. Ginna Nuclear Power Plant, LLC; Nine Mile Point Nuclear Station, LLC; and Calvert Cliffs Nuclear Power Plant, LLC to Exelon Generation Company, LLC (EGC). Specifically, due to the anticipated changes to many of the documents required for an application for Facility Security Clearance resulting from the license transfers, CENG requested NRC approval to submit the renewal application within two weeks following NRC approval of the license transfers and their implementation.

The NRC issued license amendments in References 2, 3, and 4 for Calvert Cliffs Nuclear Power Plant, LLC; Nine Mile Point Nuclear Station, LLC; and R. E. Ginna Nuclear Power Plant, LLC; respectively; to conform the renewed facility operating licenses to reflect the direct transfer of operating authority to EGC.

In a conference call with D. Hase (U.S. NRC) on March 31, 2014, EGC discussed plans to submit a complete Foreign Ownership, Control, or Influence (FOCI) package that reflects the license transfers of the former CENG plants to EGC. Although the NRC rendered a favorable FOCI review for EGC and its parents (i.e., Exelon Corporation (Exelon) and Exelon Ventures Company, LLC (EVC)), in Reference 5, the planned submittal will also include the FOCI information for EGC and its parents. In an email communication on April 10, 2014, between M. Yun (EGC) and D. Hase (U.S. NRC), it was agreed that EGC would submit the complete FOCI package by May 16, 2014. Accordingly, this schedule supersedes the information previously submitted to the NRC in Reference 1 for CENG.
