Enclosure to RA-08-088 Page 2 of 8 Introduction The Annual Report of Sea Turtle Incidental Takes provides a summary of the incidental takes of all species of sea turtles at the Oyster Creek Nuclear Generating Station (OCNGS) during the past year. The report is required by Terms and Conditions (T&C) # 8 of the Incidental Take Statement of the OCNGS Endangered Species Act Section 7 Consultation Biological Opinion.

This report covers all incidental takes and sightings of sea turtles that occurred during 2008.

Incidental Take Reports documenting the circumstances of incidental takes of sea turtles were completed following six OCNGS juvenile Kemp's ridley sea turtle incidental takes during 2008-and were provided to the National Marine Fisheries Service (NMFS) and United States Nuclear Regulatory Commission (USNRC) within 30 days of each incidental take. Sea Turtle Incidental Take Reports 2008-1 though 2008-6 are summarized below and the full reports are included in. Photographs of the six turtles were previously supplied with the individual reports and therefore are not included in this report. Sea Turtle Incidental Take Report 2008-1 At approximately 02:20 on Friday, June 27,2008, an OCNGS operator noticed a live sea turtle with its head above water in Bay # 1 of the circulating water intake. The water temperature at the time of the incidental take was approximately 78°F (25.60C) and OCNGS was in operation at 100% power with four circulating water pumps and two dilution pumps in operation. Skies were cloudy.

The turtle appeared to be healthy and was very active. OCNGS environmental personnel who took custody of the turtle confirmed it to be a juvenile Kemp's ridley sea turtle (Lepidochelys kempi. Although it is impossible to say precisely how long the turtle had been on the trash bars prior to removal, the circulating water trash racks had been inspected and cleaned earlier the same moming. The turtle was not observed during that trash rack inspection and cleaning.

The turtle measured only 21.7 cm carapace length straight line and weighed 3.4 lb. No tags were present on the turtle when captured. USNRC and NMFS personnel were notified of the incidental take within 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months . The turtle was handed over to personnel from the Marine Mammal Stranding Center (MMSC) in Brigantine, NJ at approximately 05:15 on June 27, 2008.

At the MMSC, the turtle was examined, measured, fed, and tagged (right front flipper with SS tag #SSL120; left front flipper with PIT tag #43101A6518). MMSC personnel reported that the animal was very active and suffered no major injuries.

Only minor bruising was present on plastron and-ventral. surfaces of its flippers. The turtle was subsequently released off the Maryland coast along with the sea turtle incidentally taken on July 7, 2008 (Incidental Take Report 2008-2) off the northern tip of Taylor island in Oxford, Maryland (Chesapeake Bay) due to warmer water temperatures.

Sea Turtle Incidental Take Report 2008-2 At approximately 01:31 on Monday, July 7, 2008, an OCNGS operator noticed a live sea turtle during trash removal activities in Bay #3 of the circulating water intake. The water temperature at the time of the incidental take was approximately 77.1 OF (25.0 0C) and OCNGS was in operation at 100% power with four circulating water pumps and two dilution pumps in operation.

Skies were cloudy. USNRC and NMFS personnel were notified of the incidental take within 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months .

The turtle appeared to be healthy and was active. OCNGS Environmental personnel who took custody of the turtle confirmed it to be a juvenile Kemp's ridley sea turtle. The turtle was not observed when the circulating water trash racks had been inspected at 21:19 the previous evening, four hours prior to the take. The trash racks had last been cleaned approximately 24

hours prior to the take.

The turtle measured only 25.9 cm carapace length.,straight line.and :wighed_5.9lb. No tags were present on the turtle when captured. The turtle was handed over to personnel from the MMSC in Brigantine, NJ at approximately 04:25 on July 7, 2008. At the MMSC, the turtle was examined and measured. The turtle was tagged on its right front flipper with SS tag #SSL121 and on its left front flipper with PIT. tag: #436050307B1 MMSC personnel reported that the animal was active during transport to MMSC but had numerous small Ibarnacles present on its flippers, head, carapace, and plastron. Only minor,. ruising was present on plastron and ventral surfaces of its flippers. The turtlewas subsequently released along with the sea turtle incidentally taken on June 27, 2008 (Incidental Take Report 2008-1), off the northern tip of Taylor island in Oxford, Maryland (Chesapeake Bay) due to warmer water temperatures.

Sea Turtle Incidental Take Reports 2008-3 and 2008-4 During the early morning hours of Sunday, July 27, 2008, two live juvenile Kemp's ridley turtles were incidentally taken within twenty minutes of each other in Bay #1 of the circulating water intake structure. At 01:01 that morning, a Field Supervisor conducting a routine tour noticed a live sea turtle in that intake bay and obtained assistance in gently recovering the turtle. The water temperature at the time of the incidental take was approximately 81.6 OF (27.6 0C) and OCNGS was operating at 100% power with four circulating water pumps and two dilution pumps in operation. Skies were clear.

After retrieval of the turtle was completed, the turtle was placed into a container while awaiting the OCNGS Environmental Department representative. At this time the Intake Operator began trash-raking operations in Bay #1 of the circulating water intake structure. Raking operations were immediately stopped when the

.Operator noticed a second live sea turtle in Bay #1.atapproximately 01:19. The OCNGS Environmental personnel representative who took custody of them confirmed both turtles to be juvenile Kemp's ridley sea turtles. Neither turtle was spotted when the circulating water trash racks had been inspected three hours prior to the takes at 22:05 the previous evening. The trash racks had been cleaned approximately 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months prior to the incidental takes.

The first turtle incidentally taken that morning measured 20.7 cm carapace length straight line and weighed 3.2 lb. The second turtle incidentally taken measured 25.5 cm carapace length straight line and weighed 5.4 lb. No external tags were present on either turtle, and both turtles appeared to be very active and in good health. USNRC and NMFS personnel were notified of the incidental takes within 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months .

Custody of the turtles was relinquished to a representative of the MMSC in Brigantine, NJ at approximately 03:20 on July 27, 2008. At the MMSC, both turtles were examined, fed, measured, and tagged. MMSC personnel reported that both animals were very active and suffered no major injuries.

The first turtle was reported by MMSC to have a 3 cm laceration that was healing on its left rear flipper, a one centimeter cut on the dorsal surface of left front flipper near shoulder, several 0.5 cm chips on the posterior edge of its carapace, and minor bruising on the plastron. MMSC personnel also reported that it began eating immediately upon arrival at MMSC. The first turtle was tagged on its right front flipper (SS tag #SSL1 22) and on its left front flipper (PIT tag

Upon examination by MMSC personnel, the second turtle was found very active and to have a one centimeter laceration on the dorsal surface of the left rear flipper, a missing portion of the rear right flipper tip, and minor bruising and scrapes on its plastron. The first turtle was tagged on its right front flipper with SS tag #SSL1 23 and on its left front flipper with PIT tag

Both turtles were subsequently transferred to the Virginia Aquarium and Marine Science Center in Virginia Beach, Virginia for additional treatment and rehabilitation prior to their release to the nearby Atlantic Ocean.

Sighting on July 30, 2008 At approximately 10:25 on Wednesday, July 30, 2008, an Intake Operator conducting a routine inspection of the circulating water intake structure noticed a live sea turtle in Bay #3. When the Intake Operator went to recover the turtle, it swam away back into the intake channel. The sea turtle was unable to be closely examined to identify its species or sex, but it was estimated by

Enclosure to RA-08-088 Page 5 of 8 the Intake Operator to measure roughly 1 foot (30 cm) in diameter. The intake temperature was 79°F (26.1°C) with clear skies and light grassing conditions. The Intake Structure had last been inspected for sea turtles at 04:20 on July 30, 2008 and last raked at 01:37 the same morning.

OCNGS was operating at 100% power with four circulating water pumps and two dilution pumps

-.in-operation. -Skies-were clear.

Although it is impossible to say precisely how long the turtle may have been in the vicinity of the trash bars prior to being observed, the circulating water trash racks had been inspected approximately six hours earlier and the trash racks had been cleaned less than nine hours prior to the observation of the sea turtle. USNRC and NMFS personnel were notified of the observation within 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months of the sighting.

Note that a live juvenile Kemp's ridley sea turtle (Sea Turtle Incidental Take Report 2008-5) was incidentally taken at the OCNGS on the day following this sea turtle observation. It is unknown whether the same turtle was involved in both cases or not, although the possibility exists that the turtle observed on July 30, 2008, was subsequently incidentally taken on July 31, 2008.

Sea Turtle Incidental Take Report 2008-5 At 16:52 on Thursday, July 31, 2008, an Intake Operator noticed a live sea turtle in Bay # 6 of the dilution water intake structure. The turtle was retrieved in accordance with the station's sea turtle handling procedure. The water temperature at the time of the incidental take was approximately 80.80F (27.1 °C) and the OCNGS was operating at 100% power with four circulating water pumps and two dilution pumps in operation. Skies were cloudy.

The turtle appeared to be healthy and was active. The OCNGS Environmental personnel and MMSC representatives who took custody of the turtle confirmed it to be a juvenile Kemp's ridley sea turtle. The dilution water trash racks had been inspected and raked two hours prior to the incidental take.

The turtle measured only 22.5 cm carapace length straight line and weighed 3.4 lb. No external tags were present on the turtle and the turtle appeared to be in good health. USNRC and NMFS personnel were notified of the incidental take within 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months .

The turtle was turned over to the custody of the MMSC in Brigantine, NJ at approximately 19:15 on July 31, 2008. At the MMSC, the turtle was examined, fed, and measured. MMSC personnel reported that the animal was somewhat lethargic with minor abrasions on its skin, several small barnacles present on its carapace and under its right eye, and a large barnacle under its left front flipper. Minor bruising was noted on the plastron. The turtle was treated with antibiotics for an extended time at MMSC due to its pre-existing barnacle infestation and lethargy. The turtle was transferred to the Virginia Aquarium and Marine Science Center in Virginia Beach, Virginia for continuation of its rehabilitation. Upon completion of rehabilitation, the turtle was released in the nearby Atlantic Ocean.

Enclosure to RA-08-088 Page 6 of 8 Sea Turtle Incidental Take Report 2008-6 At approximately 21:12 on Friday, September 12, 2008, an OCNGS Intake Operator who was manually removing materials from the upstream face of the trash rack in Bay # 6 of the dilution water intake noticed a sea turtle upside-down among the debris he was removing from the trash rack. The operator promptly recovered the turtle in accordance with station safe turtle handling instructions. The water temperature at the time of the incidental take was approximately 79.60F (26.40C) and OCNGS was in operation at 100% power with four circulating water pumps and two dilution pumps in operation. Rain was occurring at the time and there were light grassing conditions. USNRC and NMFS personnel were notified of the incidental take within 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months .

The turtle was obviously dead having a partially crushed carapace and a deep, narrow slice wound typical of boat propeller wounds. The turtle was severely decomposed, its: skull was skeletonized and it was missing one eye. It had many of its scutes missing. OCNGS Environmental personnel who took custody of the turtle confirmed it to be a juvenile Kemp's ridley sea turtle.. The turtle was not observed when the dilution water trash racks had been inspected less than four hours prior to the take at 17:20 the same evening. The trash racks had last been cleaned approximately 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months prior to the take.

The turtle was handed over to personnel from the MMSC in Brigantine at approximately 09:45 on September 13, 2008. At the MMSC, the turtle was examined and measured. A stranding/necropsy report was completed in which MMSC personnel reported that the animal had suffered severe trauma to its carapace and head, including a "large prop cut" indicative of a boating accident. The turtle,of undetermined sex measured only 24.5 cm carapace length straight line and weighed an" estimated 5 pounds. No flipper tags were present on the turtle when inspected. Due to the severe decomposition of the turtle, MMSC personnel were unable to perform a detailed necropsy, but did perform a cursory necropsy that was documented on Sea Turtle Stranding and Salvage Network Stranding Report Field ID # MMSC-08-127.

Following completion of the necropsy, MMSC personnel buried the turtle at the north end of Brigantine Island, New Jersey.

Comparison of Annual Sea Turtle Incidental Takes With Prior Years Regarding trends in the number of incidental sea turtle takes at the OCNGS, a total of six sea turtle incidental takes occurred during 2008. Also, one sea turtle was observed at OCNGS which was not immediately incidentally taken. All but one of the sea turtles incidentally taken at OCNGS during 2008 were alive and in good condition and were subsequently released after they were confirmed to be feeding well and moving about normally. The only sea turtle that was not alive when incidentally taken at the OCNGS appeared to have been involved in a boat collision and was severely decomposed when it was taken. Thus, it apparently died some time before it was incidentally taken and its death appears unrelated to operation of OCNGS.

The six OCNGS incidental takes during 2008 is greater than the long-term average of between two and three incidental takes per year recorded over the last sixteen years; however, the annual abundance of sea turtles in this vicinity appears to be highly variable, unpredictable, and unrelated to the operation of OCNGS. There are several factors that may influence the number

Enclosure to RA-08-088 Page 7 of 8 of sea turtle incidental takes that occur at the OCNGS. Barnegat Inlet, the only tidal inlet in the vicinity of OCNGS, which provides access to Bamegat Bay from the Atlantic Ocean, was deepened during dredging operations in the early 1990s. Completion of the Barnegat Inlet dredging operation resulted in an increase in the tidal prism, or volume of water entering and exiting the inlet on a single tidal cycle, as well as a slightly greater tidal range at OCNGS. The deepening of Barnegat Inlet and associated waterway channels was completed immediately prior to 1992, when incidental takes of sea turtles began to occur at OCNGS, and may partially explain the occurrence of the turtles.

Physical factors, such as an oceanic front or an oceanic eddy occurring unusually close to Barnegat Inlet, may also play a part in the prevalence of sea turtles near OCNGS because oceanic fronts have been shown to be used as a migratory and forage habitat by sea turtles (Polovina et al, 2000). Experience has also shown that the passage of a severe storm or pressure system near Barnegat Inlet can cause major increases in winds, waves, tides and tidal prism in shallow estuarine waters such as Barnegat Bay. These events could increase the likelihood of slowly swimming organisms such as sea turtles occurring in the estuary. Although it is likely that the local variability of sea turtle abundance is also related to biological factors including the abundance of organisms on which sea turtles prefer to feed, such as blue crabs, horseshoe crabs, and calico crabs; blue crabs were not as relatively abundant in Bamegat Bay in 2008 compared to recent years, as was the case in most other coastal bays along the Atlantic coast such as Chesapeake Bay. Therefore the relatively higher number of incidental takes in 2008 was an anomaly or the number of incidental takes could have been more had the abundance of their food source been higher under the same weather patterns and other influencing factors during 2008.

Many years of environmental sampling conducted near OCNGS have repeatedly demonstrated that the abundance of various marine organisms can vary considerably from year to year, often by orders of magnitude. This is particularly true for seasonal migrants, whose abundance in Bamegat Bay is highly dependent upon physical and biological factors along the migratory route. Therefore, the observed annual variation in sea turtle incidental takes at OCNGS from a minimum of zero to a maximum of eight per year is not considered particularly significant. The ultimate goal of the considerable effort being put forward at OCNGS for the protection of sea turtles is to protect the turtles that do arrive at the plant, and to release as many turtles as possible to safety. The OCNGS program for the protection of threatened and endangered sea turtles can be considered to be quite successful because most of the sea turtles incidentally captured at OCNGS since 1992 (with some in distress prior to being taken) have subsequently been rehabilitated and released alive and well, to the Atlantic Ocean in locations free from potential cold-shock; due to the efforts of OCNGS and MMSC personnel.

The six incidental takes of Kemp's ridley turtles during 2008 at the OCNGS did not exceed the Incidental Take Statement limit, which is currently a maximum of eight Kemp's ridleys per year.

There was only one lethal incidental take of sea turtle at the OCNGS during 2008, and its advanced state of decomposition would indicate that the death was unrelated to the operation of OCNGS. All five incidental live takes occurred prior to August.

Enclosure to RA-08-088 Page 8 of 8 OCNGS expects on-going support from the Marine Mammal Stranding Center in Brigantine, New Jersey for both transfers of live sea turtles for rehabilitation and as the primary facility for necropsies. OCNGS has noted the exceptional efforts by the MMSC staff in the care and rehabilitation of sea turtles transferred to the Brigantine facility. In recognition of this effort, OCNGS contributed $10,000.00 to the MMSC in 2008. Also during 2008, OCNGS arranged for Dr. Wurst (D.V.S.) of Bamegat, New Jersey-asa backup to perform necropsies as required by T&C # 11 of the 2006 Biological Opinion.

Sea Turtle Incidental Take Report 2008-2 At approximately 0131 hours0.00152 days 0.0364 hours 2.166005e-4 weeks 4.98455e-5 months on Monday, July 7, 2008, an Oyster Creek Nuclear Generating Station (OCNGS) operator noticed a live sea turtle during trash removal activities in Bay #3 of the circulating water intake. The water temperature at the time of the incidental take was approximately 77.1 degrees F (25.0 C) and OCNGS was in operation at 100 % power with four circulating water pumps and two dilution pumps in operation. Skies were cloudy.

The turtle appeared to be healthy and was active. OCNGS Environmental personnel who took custody of the turtle confirmed it to be a juvenile Kemp's ridley sea turtle (Lepidochevs kmmi).

Although it is impossible to say precisely how long the turtle had been In the Intake bay prior to removal, the circulating water trash racks had been inspected four hours prior to the take at 21:19 hours the previous evening. The trash racks had last been cleaned approximately 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months prior to the take.

The turtle measured only 25.9 cm carapace length straight line and weighed 5.9 lb. No tags were present on the turtle when captured. USNRC and NMFS personnel were notified of the incidental take within 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months .

The turtle was handed over to personnel from the Marine Mammal Stranding Center (MMSC) in Brigantine, NJ at approximately 0425 hours0.00492 days 0.118 hours 7.027116e-4 weeks 1.617125e-4 months on July 7, 2008. At the MMSC, the turtle was examined and measured. MMSC personnel reported that the animal was active during transport to MMSC but had numerous small barnacles present on its flippers, head, carapace, and, plastron. Only minor bruising was present. on plastron and ventral surfaces of its flippers.

At the time of thisreport, the turtle is still being held at the MMSC due to their concern regarding pre-existing heavy barnacle infestation and abnormal blood work. The turtle was recovered in accordance with the station's safe turtle handling procedure. The water temperature at the time of the incidental take was approximately 80.8 degrees F (27.1 C) and OCNGS was in operation at 100% power with four circulating water pumps and two dilution pumps in operation. Skies were cloudy and grass conditions were light.

The turtle appeared to be healthy and was active. OCNGS Environmental personnel who took custody of the turtle confirmed it to be a juvenile Kemp's ridley sea turtle (Lepidochelys kempi.

At the MMSC, the turtle was examined, measured, fed, and tagged. MMSC personnel reported that the animal was lethargic with minor abrasions on its skin and barnacles on it carapace and under its right eye. Minor bruising was present on plastron and ventral surfaces of its flippers. The turtle was transferred on August 4, 2008, along with two other turtles from OCNGS (2008-3 and 2008-4) to the Virginia Aquarium and Marine Science Center until rehabilitation is complete and arrangements for its release are finalized.

OYSTER CREEK NUCLEAR GENERATING STATION Sea Turtle Incidental Take Report 2008-6 (Reid #: MMSC-08-127)

At approximately 2112 hours0.0244 days 0.587 hours 0.00349 weeks 8.03616e-4 months on Friday, September 12, 2008, an Oyster Creek Nuclear Generating Station (OCNGS) Intake Operator who was manually removing materials from the upstream face of the trash rack In Bay # 6 of the dilution water Intake noticed a sea turtle upside-down among the debris he was removing from the trash rack. The operator promptly recovered the turtle in accordance with station safe turtle handling instructions. The water temperature at the time of the Incidental take was approximately 79.6 degrees F (26.4 C) and OCNGS was In operation at 100% power with four circulating water pumps and two dilution pumps In operation. Rain was occurring at the time and there were light grassing conditions.

The turtle appeared to have a partially crushed carapace and a deep, narrow slice wound typical of boat propeller wounds. The turtle was severely decomposed, its skull was skeletonized and it was missing one eye. It had many of its scutes missing. OCNGS Environmental personnel who took custody of the turtle confirmed it to be a juvenile Kemp's ridley sea turtle (Leoidochelvl kembl. Although it Is impossible to say precisely how long the turtle had been In the Intake bay prior to removal, the dilution water trash racks had been inspected less than four hours prior to the take at 1720 hours0.0199 days 0.478 hours 0.00284 weeks 6.5446e-4 months the same evening. The trash racks had last been cleaned approximately 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months prior to the take.

The turtle was handed over to personnel from the Marine Mammal Stranding Center (MMSC) in Brigantine, NJ at approximately 0946 hours0.0109 days 0.263 hours 0.00156 weeks 3.59953e-4 months on September 13, 2008. At the MMSC, the turtle was examined and measured.

A stranding/necropsy report was completed In which MMSC personnel reported that the animal had suffered severe trauma to its carapace and head, including a large prop cut indicative of a boating accident The turtle of undetermined sex measured only 24.5 cm carapace length straight line and weighed an estimated 5 pounds. No flipper tags were present on the turtle when inspected. USNRC and NMFS personnel were notified of the incidental take within 24 hours2.777778e-4 days 0.00667 hours 3.968254e-5 weeks 9.132e-6 months . Due to the severe decomposition of the turtle, MMSC personnel were unable to perform a detailed necropsy, but did perform a cursory necropsy that was documented on Sea Turtle Stranding and Salvage Network - Stranding Report Field ID # MMSC-08-1 27 (attached).

Following completion of the necropsy, MMSC personnel buried the turtle at the north end of Brigantine Island, New Jersey.
