I apologize for any delay in respondinq to your concerns and hope that this letter will provide you with the information that you are seeking.
He note that the UP.C has received two letters frca you dated. lune 24 and July 6, 1991. Both letters offer comnents on the Draf t Environmental Stateoent (DES).
During the telephone conversation, Mr. Youngblood explained that it is our practice to respond to coments on the pCS in the Final Environmental Statenent (FES), !!UP.EG-0775. A copy of the FES is enclosed and we wish to point out in particular that responses to your concerns are given on pages 8-7, 8-9 and 8-17.
Durinq your conversation with Mr. Youngblood you exnressed a concern about the delay in resolvinq the issue of pomanent disposal of high-level nuclear waste.
TFn following describes the status of the Connission's proceedings on this sub.icc t.
On October 25, 1979, the Comission becan a proceedinq to detemine:
- 1) whether the Comission continues to have confidence that safe off-site dis-posal of radioactive vastes from licensed facilities will be available; 2) when safe disnosal or off-site storage of radioactive wastes fron licensed facilities will be available; and 3) whether radioactive wastes can be safely stored on site past the expiration of oxisting facility licenses until off-site disposal or storage is available. 44 FR 61372, 61373.
In the notice commencing the proceed-inq the Comission said:
"durinq this proceeding the issues being considered in the rulemaking should not be addressed in individual licensing proceedings.
l These issues are most appropriately addressed in a generic proceeding of the character here envisaged.... However, all licensing proceedings now underway vill be subject to whatever final determinations are reached in this procee<iing."
Thus, pursuant to the Connission's direction, the issue of the availability of perranent disposal of nuclear wastes fron reactors currently in the licensing process, includin': the Conanche peak Steam Electric Station, will be addressed in the qeneric rulemking now underway. The Comission has completed the proceedings in this rulemakinq and has the record before it for decision. A l
decision is exnected later this year.
