RESPONSE TO LETTER FROM GEORGE CRUMP RE DISPOSAL OF NUCLEAR WASTE You requested that I provide you with a paragraph on permanent disposal of high-level waste which,(you could use to respond to Judge Crump's inquiry on Comanche Peak.

I suggest that you use the following paragraph in the response to Judge Crump:

On October 25, 1979, the Comission began a proceeding to determine: 1) whether the Commission continues to have confidence that safe off-site disposal of radioactive wastes from licensed facilities will be available; 2) when safe disposal or off-site storage of radioactive wastes from licensed facilities will be available; and 3) whether radioactive wastes ca.n be safely stored on site past the expiration of existing facility licenses until off-site disposal or storage is available. 44 FR 61372, 61373.

In the notice comencing the proceeding the Comission said:

"during this proceeding the issues being considered in the rulemakir.g should not be addressed in individual licensing proceedings. These issues are most appropriately addressed in a generic proceeding of the character here envisaged.... However, all licensing proceedings now underway will be subject to whatever final determinations are, reached in this proceeding." Thus, pursuant to the Comission's direction, the issue of the availability of permanent disposal of nuclear wastes from reactors currently in 'the licensing proce'ss, including the Comanche Peak Steam Electric Station, will be addressed in the generic rulemaking now underway. The Comission has completed the proceedings in this rulemaking and has the record before it for decision. A decision is expected later this year.
