The referenced letter provided a response to NRC questions regarding license amendment requests submitted by STP Nuclear Operating Company for deviation for Fire Protection Program requirements for South Texas Project Units 1 and 2. Attachment 1 to the Enclosure of the referenced letter contained sensitive security-related information. This letter requests that the referenced letter be made publicly available upon removal of Attachment 1 to the Enclosure of the letter.

This letter provides a justification for withholding sensitive unclassified non-safeguards information provided in the referenced letter.

Nuclear Regulatory Commission Regulatory Issue Summary (RIS) 2005-26 informed licensees of appropriate handling of information that warrants controls because of the continuing concerns about terrorist attacks against the critical infrastructure of the United States. The most recent and detailed guidance of the control of information related to operating nuclear power plants is STI: 32607268

NOC-AE- 10002513 Page 2 provided in Commission paper SECY-04-0191, "Withholding Sensitive Unclassified Information Concerning Nuclear Power Reactors From Public Disclosure," dated October 19, 2004, and the associated staff requirements memorandum dated November 9, 2004.

RIS 2005-26 also provides information on the appropriate marking of the cover letter and affected pages for withholding sensitive unclassified information.

The STP Nuclear Operating Company (STPNOC) requests that Attachment 1 to the Enclosure of the referenced letter be replaced by the Attachment of this letter. The revised pages in the Attachment reflect the marking found in RIS 2005-26 and otherwise is unchanged from the original application. STPNOC requests that this replacement Attachment be withheld from public disclosure in accordance with 10 CFR 2.390. The basis for withholding is that the information discusses mitigation strategies for achieving safe shutdown of the South Texas Project Units. This basis is similar to the basis for withholding information for Engineered Safety Features information as discussed in SECY-04-0191.
