Data Point Library Modification Ladies and Gentlemen:

In accordance with the requirements of 10CFR50, Appendix E, Section VI, Item 3a, Southern Nuclear Operating Company (SNC) is submitting changes to the Vogtle Electric Generating Plant Unit 1 and Unit 2 Emergency Response Data System (EROS) data point library. Data point UV6130 (Borated Water Storage Tank Level), was revised on both Unit 1 and Unit 2 as a result of changes to the scaling and setpoints for the Refueling Water Storage Tank level instrumentation.

The changes were implemented on July 21,2008. However, it was not recognized until September 4, 2009 that the Nuclear Regulatory Commission (NRC) had not been notified of the changes to the EROS data point library within 30 days of implementing the change as required by 10CFR50, Appendix E, Section VI, Item 3a. This deficient condition was identified during a broadness review, for a condition report, that had been generated when it was discovered, that other EROS data points had been modified and the NRC had not been notified of the changes within 30 days of making the changes as disclJssed in letter NL-09-1 088 from SNC to the NRC, dated July 10, 2009.
