Dear Sir or Madam:

The purpose of this letter is to request the withdrawal of a License Amendment Request (LAR) transmitted via Reference 1.

Entergy Nuclear Operations, Inc. (Entergy) submitted a License Amendment Request, (Reference 1) for a change to the Technical Specifications (TS) for Indian Point Nuclear Generating Unit No. 2 (IP2). Specifically, the LAR requested a change to revise the test acceptance criteria for the endurance test for the emergency diesel generators (EDG),

Technical Specification Surveillance Requirement 3.8.1.10.

The Nuclear Regulatory Commission (NRC) staff determined that additional information was needed to complete its review of the requested TS change. The request for additional information (RAI) in Reference 2 was to have been provided to the NRC by March 31, 2008. However, due to the Unit 2 spring refueling outage and other priority

NL-08-067 Docket No. 50-247 Page 2 of 2 items on-going at the site, Entergy was unable to provide the additional information in a timely manner. Entergy is therefore requesting the amendment request for the'TS change be withdrawn at this time.

Since the current TS is a non-conservative TS, Entergy has followed the guidance of Administrative Letter 98-10, and has performed endurance testing of the EDG to the criteria proposed in Reference 1. This testing is within the bounds of the EDG testing criteria previously approved in Amendment 153 and subsequently revised by the Improved Technical Specifications when adopted.

Entergy will resubmit a new amendment request for the TS change at a future time which will incorporate the responses to the questions raised in Reference 2. There are no new commitments contained in this letter.
