Cancellation of Commitment Related to Large Break LOCA Reanalysis Indian Point Nuclear Generating Unit Nos. 2 and 3 NRC Docket Nos. 50-247 and 50-286 Renewed Facility Operating License Nos. DPR-26 and DPR-64 In Reference 1, Entergy Nuclear Operations, Inc. (Entergy) submitted a 30-day report of changes in the emergency core cooling system (ECCS) models for Indian Point Nuclear Generating Unit Nos. 2 and 3 (IP2 and IP3, respectively). Entergy submitted the report in accordance with 10 CFR 50.46(a)(3)(ii) as a significant change in peak cladding temperature (PCT) due to accumulation of changes and errors such that the sum of the absolute magnitudes of the respective temperature changes is greater than 50°F. The Reference 1 report stated:
"10 CFR 50.46(a)(3)(ii) requires the licensee to provide a report within 30 days, including a proposed schedule for a reanalysis or taking other action as may be needed to show compliance with 10 CFR 50.46."
As such, Entergy established the following commitment, with a due date of on or before December 15, 2016:
Entergy will submit to the NRC LBLOCA [Large Break Loss of Coolant Accident]
analyses that apply NRC approved methods that include the effects of fuel pellet thermal conductivity degradation (TCD) for Indian Point Unit Nos. 2 and 3.
The final rule publication date for the revised 10 CFR 50.46 Performance-Based Emergency Core Cooling System Acceptance Criteria rule (Docket ID NRC-2008-0332) is October 19, 2020, as stated on the NRC planned rulemaking activities webpage.
NL-20-057 Page 2 of 3 As established by Reference 2, the revised due date to submit LBLOCA analyses that appropriately address fuel pellet thermal conductivity degradation is no later than 12 months following completion of the three stated milestones, which includes the issuance of the final rule (the other two milestones have since been met). IP2 is permanently defueled, as certified in Reference 4, and is no longer subject to 10 CFR 50.46. Adding twelve months to the current final rule publication date exceeds, with sufficient margin, the planned end of operation date for IP3 (i.e., on or before April 30, 2021, as stated in Reference 3). Therefore, a LBLOCA analysis will not be reperformed for either IP2 or IP3, and as such, Entergy is cancelling the commitment.
