On July 22, 2015, Southern Nuclear Operating Company (SNC), the licensee for Vogtle Electric Generating Plant (VEGP) Units 3 and 4, provided a supplemental response to Nuclear Regulatory Commission (NRC)Bulletin 2012-01, Design Vulnerability In Electric Power System, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML15226A058). That supplemental response stated SNC would complete the analysis and modifications to detect an open phase condition prior to fuel load for Units 3 and 4.
The purpose of this supplement is to notify the NRC of a reversion to those commitment completion dates such that the analysis and modifications to detect an open phase condition at Units 3 and 4 will be completed by the end of each Unit's second maintenance/refueling outage, as originally committed by SNC (ADAMS Accession No. ML15030A357). The Enclosure to this letter provides the revised regulatory commitments and a basis for the commitment date changes.
These commitment changes have been evaluated in accordance with the Nuclear Energy Institute guidance document NEI 99-04, "Guidelines for Managing NRC Commitment Changes."

REGULATORY COMMITMENTS DUE DATE/EVENT
- 1. VEGP Unit 3 will perform the necessary By the end of the VEGP Unit 3 second analysis and implement any subsequent maintenance/refueling outage.

Basis for Commitment Completion Date Changes This Regulatory Commitment was originally made in recognition of a significant industry event that was identified via the SNC operating experience (OE) program and the revised commitment completion due date is being made to support revised station priorities.
The (approximate) 36-month delay in implementing the actions to address the open phase condition identified in NRC Bulletin 2012-01 (the basis of the actions proposed in this commitment) is not significant to safety.
Specifically, in the API 000 design, the open phase event is the failure ofa non-safety component which has no effect on safety related functions. The offsite circuit is not safety-related, and the API000 does not attribute a defense-in-depth function to the offsitecircuit for maintaining reactor safety.
SNC's previousBulletin 2012-01 and RAI responses (e.g., SNC letter no. ND-15-0133, ADAMS accession no. ML15030A357), demonstrated that the API000 design is in compliance with GDC 17, and as concurred with by the NRC staff during October 30, 2014 public meeting, the open phase event failure is not a safety concem for the API 000 design.
Accordingly, the extension of the completion due dates for these commitments will not negatively impact the ability of a system, structure or component (SSC) to perform itssafety function or negatively impact the ability of licensee personnei to ensure the SSC is capable of performing its intended safety function.
