Robinson Steam Electric Plant, Unit 2 Subsequent License Renewal, in Darlington County, South Carolina (FWS Project Code: 2025-0116165). You have requested that the Service provide concurrence or comments regarding potential impacts to federally listed species in accordance with requirements set forth under section 7 of the Endangered Species Act of 1973, as amended, 16 U.S.C. 1531 et seq. (ESA).

Your agency has made a determination of may affect, but is not likely to adversely affect for ted-cockaded woodpecker (Leuconotopicus [Picoides] borealis). Based on the justification provided, the Service concurs with your determination. Consultation is not necessary for no effect determinations.

The tricolored bat, southern hognose snake, and monarch butterfly are all currently proposed for listing and do not have the full protection of listed species under the ESA, therefore there is no need to consult on these species.

Please note that obligations under section 7 of the ESA should be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner, which was not considered in this assessment; or (3) a new species is listed or critical habitat is determined that may be affected by the identified action.

The Service recommends that you contact the South Carolina Department of Natural Resources regarding potential impacts to State protected species. This email will serve as our official response. Please let me know if you have any questions.

Duke Energy Progress, LLC (Duke Energy), was designated by the U.S. Nuclear Regulatory Commission (NRC) as the Non-Federal Representative to prepare a biological assessment (BA) under section 7 of the Endangered Species Act of 1973, as amended (ESA), for H.B. Robinson Steam Electric Plant, Unit 2 Subsequent License Renewal. Duke Energy, as the non-federal representative of the NRC, respectfully requests your written concurrence with the NRCs determination in the attached BA that the proposed action noted within the BA is not likely to adversely affect on the Tricolored Bat, the Red-cockaded Woodpecker, the Southern Hognose Snake, or the Monarch Butterfly, as well as a no effect determination for the rough-leaved loosestrife.
