REQUEST FOR THRESHOLD DETERMINATION ACCEPTANCE LETTER (EPID L-2025-LLM-0004)
Dear Robert W. Warnement:
By letter dated September 23, 2025 (Agencywide Documents Access and Management System Accession No. ML25266A263), Duke Energy Florida, LLC, submitted a request that the Nuclear Regulatory Commission (NRC) determine if the investment of up to a 19.7% minority interest in its immediate parent company, Florida Progress, LLC, a Florida limited liability company, by Peninsula Power Holdings L.P., a Delaware limited partnership does not constitute a change of control requiring prior NRC consent pursuant to Section 50.80, Transfer of licenses, of Title 10 of the Code of Federal Regulations (10 CFR). In the alternative, if the NRC concludes that the Transaction does constitute a change of control, Duke Energy Florida, LLC requests approval of the Transaction pursuant to Section 184 of the Atomic Energy Act, as amended and 10 CFR § 50.80.
The NRC staff has reviewed your application and concluded that it provides sufficient detail to enable the NRC staff to complete its detailed technical review as well as make an independent assessment regarding the acceptability of the request in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of this initial acceptance review as compared to the detailed technical review, there may be instances in which further information is needed to support the NRC staffs ability to complete the detailed technical review. You will be advised of any further information needed by separate correspondence.
Based on the information provided in your submittal, the NRC staff has estimated that this licensing request will take approximately 75 hours8.680556e-4 days <br />0.0208 hours <br />1.240079e-4 weeks <br />2.85375e-5 months <br /> to complete. The NRC staff expects to complete this review in approximately two months, which is February 20, 2026. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager.
These estimates are based on the NRC staffs initial review of the application, and they could change due to several factors including requests for additional information or unanticipated addition of scope to the review. Additional delay may occur if the submittal is provided to the NRC in advance or in parallel with industry program initiatives or pilot applications. Your submittal has been assigned Enterprise Project Identification Number (EPID) L-2025-LLM-0004. Please reference this EPID number and Docket No. 50-302 in any future correspondence associated with this request.
