SUMMARY

REPORT FOR THE GENERAL REGULATORY AUDIT OF THE KEMMERER POWER STATION UNIT 1 CONSTRUCTION PERMIT APPLICATION (EPID NO. L-2024-CPS-0000)

Dear George Wilson:

By letter dated March 28, 2024, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24088A060), TerraPower, LLC (TerraPower), on behalf of its wholly-owned subsidiary US SFR Owner, LLC (USO), submitted a construction permit (CP) application and corresponding preliminary safety analysis report (PSAR) to the U.S. Nuclear Regulatory Commission (NRC) staff (the staff) for a reactor facility pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 50, Domestic Licensing of Production and Utilization Facilities, and section 103 of the Atomic Energy Act of 1954, as amended. The facility is referred to as Kemmerer Power Station Unit 1. On May 21, 2024 (ML24135A109), the staff accepted USOs CP application for docketing. A notice of the acceptance for docketing was published in the Federal Register on June 4, 2024 (89 FR 47997). On October 3, 2025 (ML25276A288), TerraPower, on behalf of USO, submitted revision 1 of the PSAR on the docket.

To assist with the detailed technical review of the CP application, the staff conducted a regulatory audit via USOs electronic reading room (ERR), in-person, and through a series of audit discussions. The audit focused on the review of supporting documents associated with questions identified in the audit plan (ML24187A117) and additional questions identified while reviewing the PSAR. The purpose of this letter is to provide a summary report of the staffs regulatory audit. Enclosure 1 of this summary report details the staffs audit questions and USOs resolutions of the audit questions. Enclosure 2 summarizes key aspects of the audit discussions related to materials performance that are not described in the specific audit questions in Enclosure 1. Enclosure 3 describes the staffs audit of USOs probabilistic risk assessment and supporting documentation. Enclosure 4 lists the documents provided by USO in the ERR for the staff to audit.

This summary report does not make any licensing conclusions or findings, but it is part of the administrative record of the staffs review of the PSAR and may provide information supporting the staffs safety evaluation.
