AMENDMENT 111 - APPROVAL OF LICENSE AMENDMENT REQUEST 25-01, LICENSING AMENDMENT FOR THE URENCO USA STANDARD PRACTICE PROCEDURE PLAN FOR THE PROTECTION OF CLASSIFIED MATTER (ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2025-SPR-0005)

Dear Paul Lorskulsint:

By letter dated June 16, 2025 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML25168A119), Louisiana Energy Services, LLC (LES), Urenco USA (UUSA), requested the U.S. Nuclear Regulatory Commission (NRC) approval of the UUSA Standard Practices Procedure Plan (SPPP) for the Protection of Classified Matter. The license amendment request (LAR) proposed to revise the UUSA SPPP to align current commitments within the SPPP with Title 10 of the Code of Federal Regulations (10 CFR) 95.25 (c) and (j) requirements.

The NRC staff has completed its review of the above submittal and finds that the changes proposed are in accordance with the requirements of 10 CFR Part 95 and Title 32 of the Code of Federal Regulations Part 117 and provides reasonable assurance that UUSA will adequately protect classified matter and sensitive information in its possession. Therefore, LAR 25-01 is approved. Enclosure 1 is the security evaluation report that documents the NRC staffs review.

Enterprise Project Identification number L-2025-SPR-0005 is considered closed.

Sub-paragraph h to License Condition 10 of SNM-2010 will be amended as follows (see bolded):

Standard Practice Procedure Plan for the Protection of Classified Matter dated December 12, 2003, as revised by correspondence dated July 30, 2004; March 16, 2006; November 21, 2006; November 22, 2006; March 20, 2007; Enclosures 1 and 3 transmitted with this letter contain Security Related Information. When separated from Enclosures 1 and 3, this letter and Enclosure 2 are decontrolled.

Constraint to License Condition 10.h Prior to implementation of the updated classified boundary, as detailed by the December 7, 2024 and February 7, 2025 submittals, NRC staff must complete an Operational Readiness Review and UUSA must receive a final inspection report from Region II.

In addition to the change to License Condition 10.h, License Condition 42 has also been updated to clarify the intended range for which the license condition is applicable (see bolded).

42.

With the exception of the Gaseous Effluent Vent System, there shall be no processing of U-235 enriched from 5.5 wt. percent to less than 10 wt. percent or components exposed to U-235 enriched from 5.5 wt. percent to less than 10 wt.

percent in any installed recycling systems or support systems, including the Ventilated Room, Decontamination Workshop, Liquid Effluent Collection and Transfer System Room, or Solid Waste Collection Room, until the NRC has completed a readiness review to verify the necessary changes have been implemented and the facility will be operated safely and in accordance with the requirements of the license. Systems and components that have been exposed to U-235 enriched from 5.5 wt. percent to less than 10 wt. percent shall be segregated from systems and components that have not been exposed to U-235 enriched from 5.5 wt. percent to less than 10 wt. percent until the NRC has completed the readiness review.

The above changes are documented in Amendment 111 to UUSA Materials License SNM-2010 and are attached to this letter as Enclosures 2 and 3.

Because all the activities noted above involve administrative actions, the NRC staff determined that the proposed activities do not individually or cumulatively have a significant effect on the environment. Therefore, in accordance with 10 CFR 51.22(c)(11), neither an Environmental Assessment nor an Environmental Impact Statement is warranted for this action.

In accordance with 10 CFR Part 2 Agency Rules of Practice and Procedure, a copy of this letter and Enclosure 3 will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of NRCs ADAMS.
