SUMMARY
OF SEPTEMBER 18, 2025, MEETING WITH CONSTELLATION ENERGY GENERATION, LLC ON PLANNED EXEMPTIONS AFFECTING THE NUCLEAR DECOMMISSIONING TRUST ACCOUNTS On September 18, 2025, an observation meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Constellation Energy Generation, LLC (CEG, the licensee) via webinar. The purpose of this meeting was to discuss CEGs plans to submit exemptions from Title 10 of the Code of Federal Regulations (10 CFR) section 50.82(a)(8)(i)(A) and 10 CFR 50.75(h)(1)(iv). The potential exemptions would allow Constellation to periodically transfer earnings from funds dedicated for activities consistent with the definition of decommission in 10 CFR 50.2 (radiological decommissioning) into separately maintained subaccounts within the Nuclear Decommissioning Trust (NDT) dedicated to site-specific decommissioning costs for non-radiological decommissioning activities. Potential exemptions from 10 CFR 50.75(h)(1)(iv) would allow the periodic transfers to be made without prior notification to the NRC. The licensee presented information regarding (1) an overview of the potential exemption requests, (2) the background of the need for the exemptions; (3) a basis for approval of the exemptions, and (4) an overview of the submittal strategy for the requests. For additional details on the licensees presentation, please refer to the CEGs meeting handout referenced.
The NRC staff provided feedback on the following topic:
Precedent: The NRC staff asked if the potential exemptions would be similar to the precedent referenced in the presentation slides (ML25031A350) or the precedent referenced in the email requesting the meeting (package, ML24150A002). Specifically, the staff requested if the potential exemptions would be for use of the NDT for removing specific components from the site or would the exemptions be generically for creating subaccounts within the NDT. The licensee indicated that the exemptions would be used to create subaccounts.
Approval Timelines: The NRC staff noted that the first batch of requests have a targeted submission date of October 31, 2025, with a requested approved time of 9 months (July 2026) and the second batch of requests have a targeted submission date of December 31, 2025, with a requested approved time of 6 months (June 2026). The staff asked if there was a specific need for the second batch to be reviewed earlier than the first batch. The licensee indicated that there was not a need for a more expedited review and the requested approval time for the second batch would be adjusted in the submission.
Potential Acceptance Review Issue: The NRC staff noted that the licensee plans to submit the exemption request for the Crane Clean Energy Center (Crane) on July 31, 2026, and that the restart request for Crane was still under review. The staff further noted that the potential exemption appears to be for sites that have not ceased operations and initiated the decommissioning process, and, as such, an exemption for Crane might not meet the conditions needed to accept for review. The licensee indicated that it would reevaluate when it would submit an exemption for Crane.
