ACCEPTANCE OF THE COMBINED LICENSE APPLICATION FOR THE FERMI AMERICA PRESIDENT DONALD J. TRUMP ADVANCED ENERGY AND INTELLIGENCE CAMPUS, UNITS 1-4
Dear Mr. Neugebauer:
The purpose of this letter is to communicate status of the U.S. Nuclear Regulatory Commission (NRC) staffs consideration of the submitted portions of Fermi Americas combined license application (COLA).
On June 17, 2025, Fermi America submitted Part 1 of a COLA (Agencywide Documents and Access Management System (ADAMS) Accession No. ML25169A395) for four AP1000 reactors. The reactors are proposed to be located at the President Donald J. Trump Advanced Energy and Intelligence Campus in Carson County, Texas, adjacent to the U.S. Department of Energys Pantex facility. Part 1 of the application included general, financial, and environmental information. The NRC acknowledged receipt of the initial submittal in a letter dated July 7, 2025 (ML25182A087). On August 20, 2025, Fermi America submitted Part 2 of the COLA (ML25232A199), which included non-site-specific technical chapters of the Final Safety Analysis Report and other supplemental information. The letter further stated that site-specific portions of the application were marked to be provided later because Fermi America is still working to complete those portions of the application.
Fermi America has identified additional future submittals to complete its application. The NRC staff acknowledges Fermi Americas commitment to participate in a pilot program for the environmental review under the National Environmental Policy Act. This innovative approach involves the development of an applicant-prepared environmental impact statement (EIS). The NRC staff stands ready to provide feedback or any information you may require to further streamline the review. In addition, Fermi America confirmed its plan to submit the site-specific information in Part 3 of the COLA according to the following schedule:
Applicant-prepared draft EIS package by February 28, 2026 Final draft Chapter 2 by October 31, 2026 Final Chapter 2 by December 31, 2026 The NRC issued the final design certification rule (DCR) for the AP1000 design in the Federal Register (71 FR 4464) on January 27, 2006. Applicants intending to construct and operate a plant based on the AP1000 design may do so by referencing its DCR, as set forth in Appendix D September 5, 2025

Recognizing that the AP1000 design has been previously licensed, constructed, and operated safely, and based on the information provided in Parts 1 and 2 of the COLA, which reference the standard certified design, the staff does not anticipate any safety issues with these portions of the application and is accepting Parts 1 and 2 of the COLA. The docket numbers assigned to this project are 05200051, 05200052, 05200053, and 05200054 for Units 1, 2, 3, and 4, respectively, and these numbers should be included on all future correspondence, as appropriate. Upon receipt of Part 3 of the COLA, NRC staff will be able to complete its acceptance review of the remaining portion of the COLA in accordance with 10 CFR 2.101, which includes issuance of a formal notice of opportunity for hearing in the Federal Register.
The agency encourages regular coordinated engagement between Fermi America and the NRC staff to help ensure effective and efficient development of the remaining information and facilitate the NRC review.
