SUBMITTAL OF TRIENNIAL DECOMMISSIONING FUNDING PLAN UPDATE
Dear Dr. Banovic:
During the U.S. Nuclear Regulatory Commission (NRC) staff review of the U.S. Department of Commerce, National Institute of Standards and Technology (NIST) license renewal application (Agencywide Documents Access and Management System [ADAMS] Accession Number ML23221A162), NIST requested clarification regarding when the next triennial update to NISTs Decommissioning Cost Estimate and Decommissioning Funding Plan (DCE/DFP) should be submitted. This letter documents that the NRC is expecting NISTs next DCE/DFP submittal no later than April 2028.
The requirements in Title 10 of the Code of Federal Regulations (10 CFR) 70.25(e)(2), state, in part, that [a]t the time of license renewal and at intervals not to exceed 3 years, the decommissioning funding plan must be resubmitted with adjustments as necessary to account for changes in costs and the extent of contamination. NIST submitted its most recent triennial DCE/DFP update for NRC review and approval in September 2022 (ML22293A269).
Subsequently, NIST submitted, and on April 10, 2025, the NRC approved, an application for the renewal of NISTs Special Nuclear Materials License No. 362 (ML24152A179). Because the license renewal review, which included a review of the DCE/DFP, was the most recent evaluation of the DCE/DFP submittal, NRC is expecting NISTs next DCE/DFP submittal not later than April 2028, which, in accordance with 70.25(e)(2), would be 3 years after the license was renewed.
In accordance with 10 CFR 2.390, Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS.
