NRC - DEQ - EPM Project Status Meeting Notes May 21, 2025 - 2:30 Eastern, 1:30 Central Page 1 of 3 Attendees:

DEQ approved the budget in a \
letter dated March 19, 2025. Jim Smith submitted the budget approval for concurrence; it is currently with Angela Coggins. Angela awaits a response from Rob Yalen regarding NRC approval of EPM utilizing Burns & McDonnell (an EPM affiliate) for engineering and administrative support services. Once Angela receives Rob Yalens approval, NRC will approve the 2025 Scope and Budget.
Approval to Retain Burns & McDonnell EPM submitted additional information requested by NRC and Rob Yalen in an April 25, 2025, letter. Jim Smith indicated that NRC had no objections to EPM using Burns & McDonnell but awaited a response from Rob Yalen before issuing approval. On February 28, 2025 DEQ approved EPM retaining Burns& McDonnell for the CERT to continue support as described in a \
December 23, 2024, letter. By \
letter dated May 21, 2025, DEQ confirmed this approval, provided NRC does not object.
Revised Allocation of Costs for Federal and State Accounts EPM submitted a letter proposing a revised allocation of remedial costs for Federal and State accounts on April 28, 2025. DEQ indicated they have drafted a response and will submit it soon.
Jim Smith stated the request was under Angela Coggins' review, pending approval of the 2025 Scope and Budget.
Note: Following adjournment of the meeting, EPM received a \
letter dated May 21, 2025 in which DEQ approved reallocating the requested percentages (18.9% of remediation costs to the State Account and 81.1% to the Federal Account) for costs incurred on and after January 1, 2025.
SW1/4 of Section 12 - Firearms use limitation.
Aaron Whitfield, the current owner of the former CERT parcel (SW1/4 of Section 12), informed EPM that he engaged an attorney to explore removing the firearms use limitation. His attorney suggested that the restriction was unlawful and that Mr. Whitfield should request CERT submit a letter to the Logan County, Oklahoma County Clerk requesting its retraction from the deed. EPM forwarded this information to our outside counsel for their review and guidance.
EPM will summarize the guidance received from outside counsel and issue a letter to the NRC and DEQ with a recommendation on how to proceed.
NRC - DEQ - EPM Project Status Meeting Notes May 21, 2025 - 2:30 Eastern, 1:30 Central Page 2 of 3 Site Maintenance The 2024 budget has sufficient remaining funding to conduct a site-wide mowing event; however, the 2024 Scope & Budget indicated that the mowing would be conducted by Mills under contract with Burns & McDonnell. Moving forward, EPM will contract directly with Mills directly as detailed in the 2025 Scope & Budget. As a result, EPM requested approval to contract Mills and conduct the first mowing event in 2025. NRC and DEQ had no objections to EPM contracting with Mills and conducting the first 2025 mowing event.
Utilizing 2025 Approved Budget for Key Pre-Construction Tasks To expedite the construction schedule, EPM requests approval to use the 2025 budget (once approved) for the following critical path tasks:
- Contract O6 Environmental LLC to advance the pre-engineered metal building design to 100% Issue-for-Construction (IFC).
- Authorize O6 to develop a comprehensive critical path method construction schedule and hold pre-construction planning meetings with EPM, Burns & McDonnell, and Veolia.
- Authorize Veolia to contract with their selected vendors to advance the filter skid and vertical blender designs to 100% IFC.
These tasks were not included in the 2025 budget; however, the 2025 budget does have funding to conduct unanticipated scope. Authorizing this design work prior to approval of the construction funding request will expedite the construction process. Consequently, EPM would like to initially fund this work via the unanticipated work task in the 2025 budget and later transfer the charges to the construction budget after the construction funding request has been approved.
DEQ and NRC did not object in principle to EPMs request but requested EPM issue a letter formally requesting approval to contract with these companies for these design activities.
EPM will submit a request for NRC and DEQ to approve the use of the 2025 unanticipated work funding for these key pre-construction tasks.
Status of Work/Submittals License Amendment Request - License Condition 27(e)(iv)(c)
EPM submitted a License Amendment Request replacing the 1999 SER and EA with the 2024 SER and EA in license condition 27(e) in a letter dated April 25, 2025. Jim Smith indicated that the amendment request qualified for a categorical exclusion and no environmental review was required. He further indicated that he did not expect any Request for Additional Information for the Safety Evaluation Report or Environmental Assessment and anticipated it being a simple review.
NRC will amend the license as requested following technical review and legal and management concurrence.
NRC - DEQ - EPM Project Status Meeting Notes May 21, 2025 - 2:30 Eastern, 1:30 Central Page 3 of 3 Construction Funding Request EPM has conditionally selected all contractors and vendors. Awarding contracts requires NRC and DEQ approval of contractor selections and the proposed budget for construction.
EPM anticipates submitting the construction funding request to the NRC and the DEQ by the end of May.
Construction Schedule On-site construction activities are currently anticipated to start in September. This assumes that the construction funding request is approved by early July and that EPM receives approval to move forward with the key pre-construction design tasks described above by late June.
Linda Gersey (NRC) requested that EPM keep her and Rob Evans (NRC) up to date on the construction schedule as they would like to perform an inspection during active construction and their inspection schedules are very tight.
EPM will coordinate with the General Contractor and schedule a meeting with Linda and Rob once the initial construction schedule is set so that we can discuss specific tasks and help them determine the best time to schedule the inspection.
Plan for Community Engagement As discussed in the April meeting, DEQ suggested that EPM prepare a Fact Sheet to be distributed ahead of mobilizing for remedial construction. EPM has consulted Burns &
McDonnell and proposes the following general steps:
- Develop/Distribute Door Hang fact sheets to be distributed to residents within a yet to be determined radius of the site
- Establish a website which displays the Fact Sheet and has an email address for additional questions.
- Develop a Construction Card that has a basic description of the project and contact information. On-site construction managers will have these cards on hand to provide to anyone who requests project information in person.
- Display an informational sign on the Highway 74 gate so that if someone passing by the site has a concern, they have contact information available to request additional information.
NRC and DEQ agreed in principle with this plan.
EPM will finalize the plan for community engagement and discuss the final plan during the June Project Status Meeting.
