Dear Recipients:
Solely as Trustee for the Cimarron Environmental Response Trust (CERT), Environmental Properties Management LLC (EPM) herein requests U. S. Nuclear Regulatory Commission (NRC) and Oklahoma Department of Environmental Quality (DEQ) approval to retain Burns &
McDonnell Engineering Company, Inc. (Burns & McDonnell) to continue to provide services to the CERT during 2025 and throughout the construction, startup, commissioning, and operation of decommissioning facilities.
As you are aware, John Hesemann assumed Bill Halliburtons responsibilities as Trust Administrator upon Bills retirement in January 2024. Mr. Hesemann has become knowledgeable regarding the terms and conditions of the 2011 Consent Decree and Environmental Settlement Agreement, as well as the 2011 Cimarron Trust Agreement. Mr.
Hesemann desires to ensure that Lead Agency approval to contract with Burns & McDonnell is formally documented.
Burns & McDonnell has provided engineering support, including technical hydrogeological and groundwater remediation planning and design support, for the CERT since the CERT was established in 2011. The CERT is entering a new phase in the decommissioning of the Cimarron site, having completed groundwater assessment, treatability testing, and development of a plan for groundwater remediation for which available funding should be sufficient to achieve compliance with NRC criteria for unrestricted release. In 2025, EPM will be responsible for the construction, startup, and commissioning of groundwater extraction, groundwater treatment, and treated water injection and discharge systems.

x The development of groundwater remediation plans, x
Pilot testing previously conducted for groundwater treatment and hydrological extraction and injection components, x
The design of groundwater extraction, groundwater treatment, and treated water injection and discharge systems, and x
The underlying reasons for the groundwater remediation strategy that was proposed in Facility Decommissioning Plan - Rev 3 (the D-Plan).
As EPM has done in the past, and pursuant to Section 4.4. of the Trust Agreement, EPM proposes to retain BMcD, an affiliated company, to perform engineering services for the CERT during the construction phase of the remediation project at the Cimarron Site. This will include observing, documenting and reporting to EPM activities performed by EPMs contractors during the construction, startup, and commissioning of decommissioning systems and facilities. In addition, BMcD will provide project controls (budget and schedule tracking) support and engineering support related to BMcDs design scope during construction.
EPM has also contracted with Burns & McDonnell since 2011 to provide financial and administrative support to the CERT since the CERT was established.
EPM requests NRC and DEQ approval to retain Burns & McDonnell to provide the support described above to the CERT, including financial and administrative support.
