NOTICE OF AVAILABILITY OF GENERIC ENVIRONMENTAL IMPACT STATEMENT FOR LICENSE RENEWAL OF NUCLEAR PLANTS, SUPPLEMENT 23, SECOND RENEWAL, REGARDING SUBSEQUENT LICENSE RENEWAL FOR POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2, SECOND DRAFT REPORT FOR COMMENT (DOCKET NUMBERS: 50-266 AND 50-301)
Dear Reid Nelson:
The U.S. Nuclear Regulatory Commission (NRC) staff is conducting a review of the environmental effects of the proposed renewal of the operating licenses for Point Beach Nuclear Plant Units 1 and 2 (Point Beach) for an additional 20 years. Point Beach is operated by NextEra Energy Point Beach, LLC (NextEra) and is located in Manitowoc County, Wisconsin.
NextEra submitted an application for Point Beach subsequent license renewal (SLR) by letter dated November 16, 2020, pursuant to Title 10 of the Code of Federal Regulations (10 CFR)
Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. The application is available through the NRCs Agencywide Documents Access and Management System (ADAMS), which is accessible online at https://www.nrc.gov/reading-rm/adams.html under Package Accession No. ML20329A292.
On November 9, 2021, a notice was published in the Federal Register (86 FR 62220), stating that the NRC staff had issued its draft supplemental environmental impact statement (SEIS) for comment, documenting its preliminary analysis and conclusions. The Advisory Council on Historic Preservation also received a notice of availability (ML21314A024) by mail dated November 17, 2021, and NRC requested comments on the draft SEIS.
On August 6, 2024, the NRC published a final rule (89 FR 64166) revising its environmental protection regulations in 10 CFR Part 51, Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions. The final rule updated the potential environmental impacts associated with the renewal of an operating license for a nuclear power plant for up to an additional 20 years, for either an initial license renewal or one SLR term. Plants (ML24087A133) provides the technical basis for the final rule. The final rule became effective on September 5, 2024. Accordingly, consistent with its regulations, the NRC staff has prepared a second draft report for the Point Beach SLR application to address new information obtained since the draft SEIS was published.
As stated in previous correspondence, and in accordance with Title 36 of the Code of Federal Regulations (36 CFR) Section 800.8(c), the NRC is complying with Section 106 of the National Historic Preservation Act of 1966, as amended, through the National Environmental Policy Act of 1969, as amended, process. The NRC has determined that the area of potential effects for this SLR action is the Point Beach power plant site and its immediate environs that may be impacted by ongoing routine maintenance and operational activities during the SLR term.
As discussed in the second draft report, the NRC staffs preliminary determination is that SLR would have no adverse effect to historic properties. Further, the NRCs preliminary recommendation is that the adverse environmental impacts of SLR for Point Beach are not so great that preserving the option of license renewal for energy-planning decision-makers would be unreasonable.
