LICENSE AMENDMENT 48 - APPROVAL OF REQUEST FOR PROPOSED CHANGES TO LICENSE CONDITION SG-5.6 - ENTERPRISE PROJECT IDENTIFIER L-2024-LLA-0094
Dear Daniel Ashworth:
This is regarding the submittal from BWXT Nuclear Operations Group, Inc. - Lynchburg (BWXT NOG-L) dated June 25, 2024 (not publicly available due to the sensitive, security-related, and classified information contained therein), as supplemented by letter dated November 14, 2024 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML24324A345), that requested U.S. Nuclear Regulatory Commission (NRC) approval of proposed changes to license condition SG-5.6 of special nuclear material (SNM) license number 42 (SNM-42) to align with related changes to the BWXT NOG-L Fundamental Nuclear Material Control Plan and chapter 1 of the License Application.
The NRC staff has completed its review of the request. The NRC has determined that the proposed changes to license condition SG-5.6 of SNM-42 are acceptable, and issuance of this license amendment will not significantly impact the public health and safety and the environment, will not be inimical to the common defense and security, and will not endanger life or property or the common defense and security.
Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 70, Domestic Licensing of Special Nuclear Materials, Materials License SNM-42 is hereby amended to revise license condition SG-5.6 - which has been redacted for this publicly available cover letter, as notated by (( )):
Enclosures 2 & 3 transmitted with this letter contain Security-Related Information. When separated from Enclosures 2 & 3, this letter and are decontrolled.

OFFICIAL USE ONLY SECURITY - RELATED INFORMATION SG-5.6 Notwithstanding the SNM possession limits allowed by Conditions 6, 7, and 8 of this license, and notwithstanding the material control and accounting (MC&A) requirements that would normally apply to the authorized possession and use of such SNM quantities, the (( )) is exempted from the MC&A requirements of 10 CFR Parts 70 and 74 except for those identified below. This exemption is conditional upon compliance with the licensees commitments, as given in the General Discussion Section of the Plan identified in Safeguards Condition SG-5.1, to: (1) maintain the total possessed unirradiated and unencapsulated SNM quantity at the (( )) below 1 effective kilogram per building; (2) maintain the total possessed unirradiated and unencapsulated SNM quantity at the (( )) below a level of Moderate Strategic Significance; and (3) maintain the (( )) as a separate plant located outside of the security protected area fence that encloses the BWXT Nuclear Operations Group - Lynchburg facility. Those MC&A regulatory requirements of 10 CFR Parts 70 and 74 that apply to the (( )) are as follows:
10 CFR 70.51(b)(1) through (3); 10 CFR 74.6; 10 CFR 74.11; 10 CFR 74.13(a);
10 CFR 74.15; 10 CFR 74.17(c); 10 CFR 74.19; and 10 CFR 74.31, excluding 74.31(c)(5).
All other license conditions shall remain the same. Enclosures 1 and 2 to this letter provide the amended Materials License SNM-42. The NRC staffs review is documented in a Safeguards Evaluation Report, which is Enclosure 3 to this letter. This letter concludes action on the referenced submittal, and Enterprise Project Identifier L-2024-LLA-0094 is considered CLOSED.
Enclosures 2 and 3 contain sensitive security-related information. Accordingly, they are marked as Official Use Only, and are withheld from public disclosure. When separated from the sensitive enclosures, this letter and Enclosure 1 are decontrolled and publicly available, in accordance with 10 CFR 2.390 of the NRCs "Agency Rules of Practice and Procedure."
