CALIFORNIA PROPOSED AND FINAL REGULATIONS

Dear Ira Schneider:

We have reviewed the California proposed sections 30100, 30180.1, 30181.(b), 30195.2(b),

30196(a), 30295, 30345.1-30350.2, and final sections 30345.1-30350.3, received by our office on October 09, 2024. These requirements were reviewed by comparison to the equivalent U.S. Nuclear Regulatory Commission (NRC) rules and the requirements. We discussed our review of the regulations with you on November 07, 2024.

As a result of our review, we have five comments and six editorial comments that have been identified in Enclosure 1. We have determined that if these requirements are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the revised regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS.

The State Regulation Status (SRS) Data Sheet in Enclosure 2 summarizes our knowledge of the status of other California regulations, as indicated. Please let us know if you note any inaccuracies or have any comments on the information contained in the SRS Data Sheet. 30100 N/A N/A N/A Definition: Source Material California is proposing to update the definition of source material to be identical with the NRCs definition.

California defines source material in Section 30100 of their regulations and in HSC § 114985(e). In addition to updating the definition in 30100, California also needs to update the definition in HSC § 114985(e) to avoid conflict.

2 30196 10 CFR Part 32 N/A N/A California 30196(a) incorporates by reference the definition of Sealed source and device registry found in 10 CFR 32.2. Additionally, California 30196(a)(3) substitutes any reference to the NRC to be a reference to the Department. In the definition of Sealed source and device registry the NRC cannot be substituted.

Therefore, California needs to update 30196(a)(3) to state, Except for the definition of Sealed Source and Device Registry in 10 CFR 32.2, any reference to the United States Nuclear Regulatory Commission (NRC) or any component thereof shall be deemed to be a reference to the Department as defined in section 30100.

3 30196 10 CFR 32.30, 32.31, and 32.32 N/A NRC California 30196(a)(1) incorporates by reference 10 CFR Part 32 with exceptions. California does not exclude 10 CFR 32.30, 32.31, and 32.32 which are NRC compatibility category and cannot be incorporated by reference. California needs to update 30196(a)(1) to also exclude 10 CFR 32.30, 32.31, and 32.32.

Inspection, maintenance, and opening of a source or source

2 STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS holder California 30346.7(d) and (e) describe maintenance and opening activities of a source holder which must be approved by the Department. In 10 CFR 39.43(d) and (e), it describes that these activities need to be specifically approved by the Commission or an Agreement State.

California is inadvertently removing the authority of NRC and other Agreement States. California needs to update 30346.7(d) and (e) to state, by the Department, NRC, or an Agreement State.

5 30348.2 10 CFR 39.63(l)

Operating & Emergency procedures California 30348.2 does not contain an equivalent regulation for 10 CFR 39.63(l) which describes identifying and reporting to the NRC defects and noncompliance as required by 10 CFR Part 21. Although Agreement States are not allowed to adopt 10 CFR Part 21, California needs to add a section stating that defects and noncompliance should be identified and reported. California can decide if these reports should go to either the Department or to the NRC as required by 10 CFR Part 21. This is required to meet the compatibility category C designation of 10 CFR 39.63.

30196(a)(7) 10 CFR Part 32 N/A N/A In 30196(a)(7), California references Ten CFR. California can consider updating this to say 10 CFR for consistency.

3 STATE SECTION NRC SECTION RATS ID CATEGORY SUBJECT and COMMENTS 2

30196 10 CFR Part 32 N/A N/A California 30196(a) incorporates by reference 10 CFR Part 32 with exceptions. In 30196(a)(3) and (a)(4),

California provides reconciliatory language for references to the NRC and for the term Agreement State.

This reconciliatory language inadvertently removes the role of the NRC from Californias regulations.

California does not include reconciliatory language to substitute the NRC back into its regulations.

Therefore, California should consider updating 30196(a)(4) to say, In 10 CFR 32.51a(b); 32.51a(b)(1) and (4);

32.51a(e); 32.52(b); 32.52(b)(7);

32.55(d); 32.56; 32.62(e); and 32.74(a)(3) where a reference is made to an Agreement State, it means an Agreement State or the NRC. Any reference to the term Agreement State shall be deemed to be a reference to the term Agreement State as defined in section 30100.

Similarly, California should consider other conditions with additional reconciliatory language to ensure the NRC is substituted back into its regulations: A reference to Commission or Agreement State or Commission or an Agreement State, means the Department, the NRC, or Agreement State. A reference to comparable provisions of an Agreement State means comparable provisions of the NRC or of an Agreement State. A reference to "equivalent regulations of an Agreement State means NRC regulations in Title 10 of the Code of Federal Regulations, or equivalent regulations of an Agreement State.

California can consider updating 30196(a) to include an exception that NRC Form 653 referenced in section 32.52 is a reference to [insert appropriate form].

4 30196 10 CFR Part 32 N/A N/A In 10 CFR Part 32 (though this may be applicable beyond part 32 to other incorporated by reference provisions),

there are citations to 10 CFR sections using only the phrases § of this chapter or under § [section number]. As an example, this occurs twice in the incorporation by reference of 10 CFR 32.13, where under § 30.14 of this chapter and under § 32.11 are used. Because these are incorporated by reference it is not clear that the chapter being referenced is 10 CFR. To resolve this issue, California needs to either, at each instance, include reconciliation language stating in 10 CFR 32.13, the phrase 30.14 of this chapter is replaced by 10 CFR 30.14 and the phrase under 32.11 is replaced by under 10 CFR 32.11. Or to resolve the issue globally,reconciliation language can be added stating where there are cross references to other NRC regulations incorporated by reference, the words of this chapter or under mean Chapter 10 of the Code of Federal Regulations.

5 30196 10 CFR Part 32 N/A N/A 10 CFR Part 32 includes various labeling requirements that California incorporates by reference. As California regulations currently read, these labeling requirements would be altered by the reconciliation language California has added for incorporation by reference purposes. To ensure that the content of the labels mentioned in 10 CFR Part 32 are not inadvertently altered by reconciliation

This statement would ensure that the content of the labels mentioned in 10 CFR remain the same in Californias regulations.

California 30350.3 is titled Notification of Incidents and Lost Sources; Abandonment Procedures for Irretrievable Sources but only speaks to irretrievable and ruptured sources, not other incidents like theft or loss. California could consider addressing these other incidents in this regulation or updating the title to only cover ruptured and irretrievable sources.
