WESTINGHOUSE ELECTRIC COMPANY, LLC. - FINAL SAFETY EVALUATION FOR TOPICAL REPORT EVR-LIC-001-P/NP, WESTINGHOUSE PRINCIPAL DESIGN CRITERIA TOPICAL REPORT FOR THE EVINCITM MICROREACTOR (EPID: L-2023-TOP-0040)

Dear Mr. Schoedel:

By letter dated June 28, 2023 (Agencywide Documents Access and Management System, Accession Number, ML23179A196), Westinghouse Electric Company, LLC. (WEC) submitted the EVR-LIC-RL-001-P/NP, Principal Design Criteria [PDC] Topical Report [(TR)], Revision 0, for the U.S. Nuclear Regulatory Commission (NRC) staffs review of the safety evaluation (SE).

By email dated August 15, 2023 (ML23226A275), the NRC staff accepted the subject TRs for review. On September 15, 2023 (ML23271A068) and October 31, 2023 (ML23331A266), the NRC staff held clarification meetings support the review and development of the SE. By email dated November 16, 2023 (ML23325A036), the NRC staff issued requests for additional information (RAIs) to WEC. By letter dated May 15, 2024 (ML24137A080), WEC submitted Revision 1 of the eVinciTM Microreactor PDC incorporating changes from the clarification meetings and RAI responses.

The NRC staff's final SE for the TR is enclosed. Enclosure 1 is the redacted version of the SE and will be made publicly available. Enclosure 2, contains proprietary information and access to this document will be controlled consistent with the regulations in Title 10 of the Code of Federal Regulations, section 2.390, Public inspections, exemptions, requests for withholding.

The NRC staff concluded that that WEC developed a sufficient set of PDCs that are appropriate for establishing requirements for the eVinciTM Microreactor design. The subject TR is therefore suitable for referencing in future licensing applications for the eVinciTM Microreactor, subject to the limitations and conditions included in section 4.0, Limitations and Conditions, of the SE.

The NRC staff requests that WEC submit an accepted proprietary and non-proprietary version of the PDC TR within 3 months of receipt of this letter. The accepted version shall incorporate this letter and the enclosed SE.
