U.S. Federal Drug Testing History 1971, President Nixon established drug testing of U.S. soldiers returning from Vietnam. Because of high positive rates, the U.S. Department of Defense established random testing in 1974.

1986, President Reagan signed Executive Order 12564, Drug-Free Federal Workplace (established drug testing of Federal employees) 1989, NRC established 10 CFR Part 26 to drug and alcohol test workers at commercial nuclear power plants 1989-1991, U.S. Department of Transportation established drug and alcohol testing of workers in aviation, trucking, public transit, and maritime industries Slide 3

NRC Rulemaking History, 10 CFR Part 26 1989 - established Part 26 to drug and alcohol test workers at commercial nuclear power plants licensed under 10 CFR Part 50, Domestic Licensing of Production and Utilization Facilities (54 FR 24468) 1993 - applied Part 26 to workers at Category I special nuclear material facilities licensed under 10 CFR Part 70, Domestic Licensing of Special Nuclear Material (58 FR 31467) 2008 - significantly enhanced Part 26 in a variety of areas (73 FR 16966):

o Updated testing technologies, drug testing panel, and methods to identify cheating o

Created a fatigue management program (work hour controls) o Incorporated enhancements from security orders issued in response to the terrorist attacks on September 11, 2001 o

Created optional/more flexible FFD program during reactor construction o

Applied Part 26 to commercial nuclear power plants licensed under 10 CFR Part 52, Licenses, Certifications, and Approvals for Nuclear Power Plants.

2022 - targeted enhancements to drug testing capabilities, testing panel, and methods to identify cheating attempts (87 FR 71422)

When is Part 26 Drug & Alcohol Testing Performed?

Pre-access: to grant initial, updated, or reinstated authorization Random: 50% annual drug and alcohol testing rate (statistically random, and unannounced, equal probability of selection and testing)

For cause: workers behavior/physical condition indicates possible impairment, or credible information on substance abuse Post-event: following human error resulting in significant illness or injury, radiation exposure or release, or degradation in plant safety Followup: verify continued abstinence from substance abuse Slide 7

How Does NRC Evaluate FFD Performance?

Collect, assess, and trend site-specific data reported to the NRC by licensees:

- Annual FFD program testing data (10 CFR 26.717) hour and 30-day event reports (10 CFR 26.719)

Inspect each sites FFD program (every 3 years)

Engage with Federal agency testing partners

- U.S. Health and Human Services

- U.S. Department of Transportation

- U.S. Department of Defense Engage with industry stakeholders (e.g., answer licensee questions; present information, trending, and operating experience at conferences)
