JAMES A. FITZPATRICK NUCLEAR POWER PLANT - CORRECTION LETTER OF AMENDMENT NO. 355 RE: REVI SE TECHNICAL SPECIFICATIONS SECTION 3.4.3.1, SAFETY RELIEF VALVES SETPOINT LOWER TOLERANCE (EPID L-2023-LLA-0103)

Dear David Rhoades:

By letter dated June 26, 2024 (Agencywide Documents and Access Management System Accession No. ML24136A116), the U.S. Nuclear Regulatory Commission (NRC, the Commission) issued the Amendment No. 355 to Renewed Facility Operating License No. DPR-59 for the James A. FitzPatrick Nuclear Power Plant. The amendment revised the Technical Specifications 3.4, Reactor Coolant System (RCS), Section 3.4.3, Safety/Relief Valves (S/RVs). Specifically, Constellation Energy Generation, LLC proposed a new safety function lift setpoint lower tolerance for the S/RVs as delineated in SR 3.4.3.1. The proposed change revised the lower setpoint tolerance from -3 percent to -5 percent.

The NRC staff has identified that due to inadvertent error, the Enclosure 1, Page 1, Paragraph 1. A of the Amendment No. 355 was issued with the incorrect entity name, Exelon Generation Company, LLC. The correct entity name is Constellation Energy Generation, LLC.

The NRC staff has concluded that the error was int roduced during the preparation of the license amendment. The correction does not change any of the conclusions in the safety evaluation associated with the amendment and does not affect the associated notice to the public.

AMENDMENT TO RENEWED FA CILITY OPERATING LICENSE

Amendment No. 355 Renewed Facility Operating License No. DPR-59

1. The U.S. Nuclear Regulatory Commission has found that:

A. The application for amendment by Constellation Energy Generation, LLC, dated July 28, 2023, as supplemented by letter dated February 29, 2024, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act) and the Commissions rules and regulations set forth in 10 CFR Chapter I;

B. The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission;

C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations;

D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and

E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied.
