LOUISIANA ENERGY SERVICES, LLC, - AMENDMENT 102, APPROVAL OF URENCO USA EXECUTED FINANCIAL ASSURANCE INSTRUMENTS FOR 2024 DECOMMISSIONING FUNDING (ENTERPRISE PROJECT IDENTIFIER L-2023-DFA-0010)
Dear Paul Lorskulsint:
The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed the Urenco USA (UUSA) executed financial assurance instruments for the 2024 decommissioning funding submitted via letter dated December 14, 2023 (Agencywide Documents Access and Management System
[ADAMS] Accession No. ML23348A271). The NRC staff concludes that there is reasonable assurance that the necessary funds will be available to support the continued safeguard, use and disposal of special nuclear materials possessed and used under special nuclear material license number 2010 (SNM-2010) at the time of licensed activities termination.
Pursuant to Title 10 of the Code of Federal Regulations (10 CFR) Part 70, SNM-2010 License Condition (LC) 10.af is hereby amended to read as follows:
10.af Decommissioning Financial Assurance submitted by letters dated December 12, 2019 (ML19351C772), October 12, 2020 (ML20296A196), April 1, 2021 (ML21109A186),
December 15, 2021 (ML22063A481), December 13, 2022 (ML22354A126), and December 14, 2023 (ML23348A271).
In addition to the change to LC 10.af, numerous administrative changes are being made to the license to clean up the license. LC 10.e has been updated to include dates of major changes to the Fundamental Nuclear Material Control Plan since June 2011 that were approved by the NRC. LC 10.q dictated that UUSA had until August 1, 2010, to fulfill specific commitments in the Fundamental Nuclear Material Control Plan. UUSA fulfilled the commitments prior to August 1, 2010, thus LC 10.q is being deleted. LC 10.x indicated UUSA had an exemption until the completion of the Centrifuge Test Facility (CTF) conversion to resume its inventory program for the CTF area. CTF conversion was addressed by a license amendment request dated transmitted by this letter contains Proprietary Information and Enclosure 2 contains Security-Related Information.
When separated from Enclosures 1 and 2, this letter and Enclosure 3 are decontrolled.

OFFICIAL USE ONLY - SECURITY-RELATED INFORMATION November 15, 2012, (ML12325A068, non-public) and approved by the NRC on February 7, 2013 (ML13022A132, non-public). Thus, LC 10.x is being deleted. The wording in LC 11 was inadvertently changed to from National Enrichment Facility to National Essential Functions and has been changed back to National Enrichment Facility. LC 26 required that UUSA shall not use, process, store, reproduce, transmit, handle, or allow access to classified matter except as required under 10 CFR Part 95. The requirements for how UUSA will protect classified matter are documented in their Standard Practice Procedure Plan (SPPP), which is covered by LC 10.h. Thus, LC 26 is being deleted. LC 31 requires that UUSA notify the NRC prior to designating areas where dissemination of classified information will routinely occur. Per 10 CFR 95.19(a), licensees are required to do what LC 31 states. A LC is not needed to address the requirement of a regulation. Additionally, requirements for UUSA protection of classified matter is documented in their SPPP. Thus, LC 31 is being deleted. With LC 34, UUSA received relief from performing an annual evacuation drill for the criticality alarm. The LC expired on December 31, 2021; thus LC 34 is also being deleted. With LC 35, UUSA received exemption from performing the biennial emergency plan exercise in 2021 but was required to complete the exercise within 35 months of the previous exercise performed in October 2019. UUSA performed an emergency plan exercise on May 11, 2022, which satisfied the exemption. Thus, LC 35 is being deleted.
The review by the NRC staff is documented in the safety evaluation report enclosed to this letter (see Enclosure 1, non-public). Enclosures 2 and 3 to this letter provide non-publicly available and publicly available versions of the amended SNM-2010 license, respectively. This letter closes efforts under Enterprise Project Identifier L-2023-DFA-0010.
Because all the activities noted above involve administrative actions, the NRC staff determined that the proposed activities do not individually or cumulatively have a significant effect on the human environment. Therefore, in accordance with 10 CFR paragraph 51.22(c)(11), neither an Environmental Assessment nor an Environmental Impact Statement is warranted for this action.
In accordance with 10 CFR Part 2, Agency Rules of Practice and Procedure, a copy of this letter and Enclosure 3 will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS.
