In Reference 1 NEPB submitted its Environmental Report in support of the Subsequent License Renewal Application for Point Beach Nuclear Plant (PBNP), Units 1 and 2. The NRC issued Reference 2 for comment and conducted two comment gathering public meetings as documented in Reference 3.

On February 24, 2022, the NRC Commission issued three orders (CLl-22-02, CLl-22-03, and CLl-22-04) and Staff Requirements Memorandum SECY-21-0066, "Rulemaking Plan for Renewing Nuclear Power Plant Operating Licenses - Environmental Review," that impacted Subsequent License Renewal for PBNP Units 1 and 2. The NRC has since proceeded with rulemaking to revise 10 C.F.R. § 51.53(c)(3) in accordance with Reference 4. The Commission approved in Reference 5 a final rule to amend Part 51 of Title 1 O of the Code of Federal Regulations, "Environmental Protection Regulations for Domestic Licensing and Related Regulatory Functions," with changes provided in Reference 6.

Given References 5 and 6, NEPB is requesting that the NRG provide its plan for re-engagement and completion of the PBNP Units 1 and 2 Final Supplemental Environmental Impact Statement for Subsequent License Renewal.

NEPB believes an audit would be the most efficient way for the NRC to resolve any remaining environmental issues raised by the Final Rule. NEPB is prepared to support an expeditious issuance of a Final Supplemental Environmental Impact Statement for Subsequent License Renewal for PBNP Units 1 and 2.
