Dear Julia Shenk:

By letter dated February 5, 2024 (Agencywide Documents Access and Management System

[ADAMS] Package Accession No. ML24060A090), as supplemented on April 1, 2024 (ML24164A259), the U.S. Department of Energy submitted an application for revision of Certificate of Compliance (CoC) No. 9315 to the Model No. ES-3100 transport package. Among other changes, the application proposes addition of tri-structural isotropic (TRISO) fuel and addition of Packcrete thermal insulating and impact limiting material.

We have completed the acceptance review of your application and determined that it contains sufficient technical information in scope and depth. Therefore, your application has been accepted for detailed technical review. Your application has been assigned Cost Activity Code/Enterprise Project Identification No. 001029/ L-2022-LLA-0116. Please reference this number and Docket No. 71-9315 in any future correspondence associated with this request.

Please note that the U.S. Nuclear Regulatory Commission (NRC) staffs technical review of your submittal may identify issues that could require that you provide additional information. Based on our preliminary evaluation and projection of current review schedules, we anticipate completing our formal review of the application by August 9, 2024. The schedule includes the issuance, if needed, of a request for additional information (RAI) by September 9, 2024, and, provided that we receive your responses to the RAI within 30 days after its issuance, we anticipate issuing the CoC/Safety Evaluation Report by December 6, 2024. Please note that these dates could change depending on the findings of our technical review, urgent assignments, or other factors, such as whether your responses to the RAI are or not adequate.

The NRC staff estimates that completing the review of your submittal will require approximately 1035 staff hours which corresponds to about $310,500 at the current NRC hourly rate of

$300/staff hour. We will promptly communicate significant schedule and/or cost changes, if any.

In accordance with Title 10 of the Code of Federal Regulations (10 CFR) Part 2, Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS.
