ISSUANCE OF THE NUCLEAR REGULATORY COMMISSION FACILITY SECURITY CLEARANCE FOR THE GLOBAL LASER ENRICHMENT NEW HEADQUARTERS BUILDING
Dear Bryan Fishel:
By letter dated August 25, 2023 (Agencywide Documents Access and Management System
[ADAMS] Accession No ML23243A847)), Global Laser Enrichment (GLE) requested approval of a Standard Practice and Procedures Plan (SPPP) for the new Global Laser Enrichment Headquarters, located at 4110 US Hwy 421, Suite 100, Wilmington, NC 28401. GLE was previously granted a facility security clearance (FCL) by the Nuclear Regulatory Commission (NRC) for their facility on Castle Hayne Road on January 29, 2021 (ML21026A048).
By package dated May 1, 2024 (ML24037A127), the NRC notified you that it had completed its review of the Standard Practice Procedure Plan for the Protection of Classified Matter and the approval of the Classified Matter Transportation Security Plan for the GLE Headquarters location and found them both acceptable. The details associated with the review of these plans are documented in the enclosures to the approval letter, see SPPP Safeguards Evaluation Report (SER) (ML24037A129 - non-public) and TSP SER (ML24072A064 - non-public).
On April 25, 2024, NRC completed an onsite readiness review of the GLE Headquarters building. The review did not identify any violations of more than minor significance. The details associated with this review were recently provided to you (ML24124A117). Following the ORR, GLE submitted the non-substantive updates to the SPPP and TSP via letter dated April 26, 2024 (ML24122C628).
On January 5, 2021, the NRC conducted a Foreign Ownership, Control, or Influence (FOCI) review of GLE. The review concluded that implementation of the mitigation measures, recommended by the NRC and committed to by GLE, will ensure that the degree and extent of FOCI over GLE will not pose an undue risk to national security (ML20290A397). These FOCI measures have been committed to in the recently submitted SPPP.
Based on the commitments in the updated SPPP and TSP, as documented in the SERs; the onsite readiness review; and FOCI determination, the NRC staff hereby grants GLE a facility security clearance to allow classified information, up to SECRET-Restricted Data, to be used, processed, stored, reproduced, transported and handled at the GLE facility located at 4110 US Hwy 421, Suite 100, Wilmington, NC 28401.
