SUMMARY

REPORT ON THE REGULATORY AUDIT OF THE ADVANCED LOGIC SYSTEMVERSION 2 DIGITAL PLATFORM AND DEVELOPMENT PROCESS AUGUST 28, 2023 - February 13, 2024

1.0 BACKGROUND

Westinghouse Electric Company, LLC., (Westinghouse) began pre-application discussions with the U.S. Nuclear Regulatory Commission (NRC) staff regarding its eVinciTM microreactor in calendar year 2020. As part of its pre-application activities, Westinghouse has submitted various topical reports and white papers. On December 21, 2022, Westinghouse submitted to the NRC staff, the Topical Reports, Advanced Logic System v2 Platform Topical Report, and Advanced Logic System v2 Development Process Topical Report (Agencywide Documents Access and Management System (ADAMS) Accession No. ML22355A230). The purpose of the Advanced Logic System (ALS) v2 Topical Reports was to describe the enhancements that have been included to create the second generation of the ALS platform, known as ALS v2, and to define the overall life cycle development process and to identify the detailed supporting processes by which the safety-related I&C activities will be executed for the ALS v2 platform development and maintenance, and applications of the ALS v2 platform.

The NRC staff submitted the audit plan to Westinghouse on September 27, 2023 (ML23244A651). The audit was conducted from August 28, 2023, through February 13, 2024, using the Westinghouse electronic reading room, virtually. The NRC staff requested this audit as part of its review of the topical reports and development of the safety evaluation report.

2.0 AUDIT REGULATORY BASES A regulatory audit is a planned license or regulation-related activity that includes the examination and evaluation of primarily non-docketed information. The audit is conducted with the intent to gain an understanding, to verify information, and to identify information that will require docketing, to support the basis of a licensing or regulatory decision. Performing a regulatory audit is expected to assist the NRC staff in efficiently conducting its review and gaining insights to the applicants processes and procedures. Information that the NRC staff relies upon to make the safety determination must be submitted on the docket.

The NRC staff will perform the audit in accordance with NRR Office Instruction LIC-111, Regulatory Audits, Revision 1, dated October 2019 (ML19226A274).

3.0 AUDIT PURPOSE AND OBJECTIVES The objective of this audit was to verify, via an independent evaluation, that the ALS v2 platform and its development process conform to the applicable regulations, standards, guidelines, plans, and procedures by assessing the implementation of the systems developmental life cycle processes.

During the audit, the NRC staff also reviewed supporting documentation to determine if the docketing of additional information was required to develop and support any conclusions for the NRC staffs safety evaluation of the topical reports.

OFFICIAL USE ONLY - PROPRIETARY INFORMATION OFFICIAL USE ONLY - PROPRIETARY INFORMATION 4.0 SCOPE OF THE AUDIT AND AUDIT ACTIVITIES The NRC staff conducted the audit from August 28, 2023, to February 13, 2024, via Westinghouses electronic reading room platform. The regulatory audit followed the guidance in NRR Office Instruction LIC-111, Regulatory Audits (ML19226A274). The audit focused on the information that was provided by Westinghouse via the online reference portal.

The audit closeout and exit meeting was held on XXXX, at which the NRC staff reiterated the purpose of the audit and discussed the activities conducted.

5.0

SUMMARY

OF OBSERVATIONS The NRC staffs summary of observations listed below is based on the notes taken by the NRC staff during the audit. In particular, the NRC staff noted:

Many of the documents reviewed in the audit, serve as high level documentation that point to lower-level documents that were either not part of the audit scope or not yet available for audit.

OFFICIAL USE ONLY - PROPRIETARY INFORMATION OFFICIAL USE ONLY - PROPRIETARY INFORMATION The ALS v2 Platform Project Management Plan provided the NRC staff with a generalized overview of the scope of the ALS v2 platform and the noted differences between it and the original ALS Platform Topical Report. The plans scope explains that the plan does not go beyond the integration phase of the development as the scope of those activities would be part of future, application-specific projects.

6.0 REQUESTS FOR ADDITIONAL INFORMATION RESULTING FROM THE AUDIT As part of the NRC staffs review, the NRC staff determined that no requests for additional information (RAIs) related to this topical report were necessary, based on the scope presented in the report. However, the NRC staff does anticipate future submittals and interactions in this topical area.

7.0 OPEN ITEMS AND PROPOSED CLOSURE PATHS There are no open items as a result of this audit. However, during the review of the topical reports and the development of the Draft SE, Westinghouse committed to resolve the following issues when submitting the -A version of the topical reports:

1. Clarification of the phrase: software safety personnel-to avoid using the term in a generalized manner among the design team, the V&V team, IV&V team and/or the global quality assurance team.
2. Independence Claim - Clarification of how Westinghouse is implementing the independence requirement of Title 10 of the Code of Federal Regulations Part 50, Domestic Licensing of Production and Utilization Facilities, Appendix B, Quality Assurance Criteria for Nuclear Power Plants and Fuel Reprocessing Plants.

Westinghouse has stated that both Criteria I and III are met.
