I am writing regarding your March 4, 2024, submittal related to Diablo Canyon, Units 1 and 2 (DCPP) seismic core damage on behalf of San Luis Obispo Mothers for Peace, Friends of the Earth and Environmental Working Group (collectively Petitioners) (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24067A066). As noted in the March 12, 2024, NRC response (ML24072A529), your request was referred to the NRC Executive Director for Operations for consideration under 10 C.F.R. § 2.206. The 2.206 process provides that any person may file a request to institute a proceeding pursuant to § 2.202 to modify, suspend, or revoke a license, or for any other action as may be proper.

Following evaluation in accordance with Section II.A.2(c) of NRC Management Directive (MD) 8.11 Review Process for 10 CFR 2.206 Petitions (ML18296A043), the NRC staff has concluded that no immediate action is necessary.

As documented in the NRC staff's assessment (ML18254A040) of PG&E's seismic probabilistic risk assessment, the seismic risk for DCPP has been adequately characterized. As such, DCPP continues to operate in a manner that provides reasonable assurance of the public health and safety. Therefore, the NRC staff concludes that there is no imminent safety concern that warrants immediate shutdown of DCPP.

However, the NRC staff has concluded that the concerns raised in your petition regarding seismic hazards at DCPP have screened into the 2.206 process in accordance with Section II.A.2(a) of MD 8.11 and a Petition Review Board (PRB) will begin evaluating your concern for acceptance in accordance with Section III.C of MD 8.11. I have been appointed Petition Manager for the evaluation of your submittal and will keep you informed of the status as the PRBs review progresses. As stated in your petition, your concerns related to the Diablo Canyon, Unit 1 reactor pressure vessel were submitted to the NRC previously (ML23257A302). These Unit 1 concerns are already being evaluated under 2.206 and will not be considered as part of your March 4, 2024, petition evaluation.

As the PRB undertakes its evaluation, I would like to make you aware that because the 2.206 petition process is a public process, the submittal and all information contained therein, including your identity, will be made public. Please feel free to contact me with any questions about the process and/or the status of the PRBs evaluation at any time.
